C) 5, 6 WHEREAS, in accordance with RCW .35.13 of the. Laws of the r-; 7 State of Washington the owners of notless than seventy-five (75%)":-? percent in value according to the assessed valuation for general {:, 8 taxation of certain lands situated in King County, Washington, 9 and more particularly described hereinafter iri this Ordinance, Q 10 filed withthe. City Council of the City of Kent, Washington their F .... petition in writing to have annexed to the City the said 11 described land, and 12 WHEREAS, in accordance with RCW 35.13 of the Laws of the 13 State of Washington various proceedings were had, and WHEREAS, within sixty (60) days of the filing of the 14 notice of intention of said annexation, the jurisdiction of the �= 15 King County. Boundary Review. Board was invoked and thereafter 16 following procedures as set forth in RCW 36.93 of the LawE of the State of Washington, the Boundary Review Board after hearing 17 thereon and pursuant to King County Review Board file No. 178 18 did on the 25th day of September, 1969 approve said annexation and 19 WHEREAS, thereafter public hearings were held on said annexation pursuant to proper notices tYerefor before the Kent City 20 Council, and 21 WHEREAS, it appears to the City Council of the City of 22 Kent, Washington that said annexation meets the requirements specified by law, the procedures from the filing with the City of 23 Kent by the requisite number of property owners of their notice 24 of intention to commence annexation proceedings, to and including 25 the consideration of the passage of this Ordinance also meet the requirements specified by law and the lands sought to be annexed 26 are contiguous to the City of Kent and have not heretofore been 27 incorporated in or as a City or Town, 28 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: 29 Section 1. That there shall be annexed to the City of 30 Kent, Washington, the following described land situated in the 31 County of King, State of Washington, to -wit: 32 -1- 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 2. That the property hereby annexed shall be assessed and taxed at the same rate and on the same basis as other property within theCity of Kent is assessed and taxed to pay for any outstanding general indebtedness of the City to which the area was annexed and which was contracted prior to or in existence at the effective date of this annexation. Section 3. That upon the 20th day of November, 1969, the annexation of said property will become effective .and said property shall become a part of the City of Kent, subject to all of the laws and ordinances of the City then and thereafter in effect except as otherwise provided by law. Section 4. Notice is hereby given that as of the effective date of the annexation all franchises or permits here tofore granted to any person, firm or corporation by the State of Washington, or by the governing body of the annexed territory, authorizing or otherwise permitting the operation of any public transportation, garbage collection and/or disposal or other similar public service business or facility within the limits of the annexed territory are cancelled; but the holder of any such franchise or permits herewith cancelled are herewith granted by the City of Kent the franchise to continue such business within the annexed territory for a period of ten (1.0) years from the effective date of this annexation. Section 5. Within thirty (3.0) days from the passage, approval and publication of this Ordinance as provided by law, -2- I That portion of Sec. 20, Twp. 22 N, Range 5 E, W.M. in King County, Washington; and all of Tact 2 4, R. p. Smith's Orchard Tracts to Kent as recorded in Vol. 12, pg. 27 of Plats, as 3 described as follows: 4 Beginning at the NW corner of the NE 1/4 of the co r. NW 1/4 of Said Sec. 20, being the True Point of 0 5 Beginning of property herein described; .D 6 Thence S along the W line of said subdivision to an intersection with the Ely production of 7 the S line of said tract; i�- 8 Thence W along said produced line and said S line to the SW corner of said tract; 8 Thence N along the W line of said tract and its 10 W line produced to the N line of said NW 1/4; 11 Thence 11 along said N line of said NW 1/4 to the True Point of B4nning. 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Section 2. Within thirty (3.0) days from the passage, approval and publication of this Ordinance as provided by law, -2- I the City Clerk of the City of Kent shall underthe :directions 2 of the Mayor of the City of Kent determine the resident population of the annexed territory which population determination shall 3 consist of an actual enumeration of the population which shall be co -- 4 made in accordance with practices and policies and subject to O5 .,approval of the Planning and Community Affairs Agency of the State of Washington and which population shall be determined as of 6 QQ the effective date of annexation as specified in this Ordinance. 7 Section 6... Within thirty (3Q)days after the effective 8 ;date of the annexation referred to in this Ordinance the City Clerk of theCity of Kent shall prepare a certificate signed by the 8 Mayor and attested by the City Clerk in such form and containing 10 such information as shall be prescribed by the Planning and 11 Community Affairs Agency of the State of Washington and said City Clerk shall thereafter submit said certificate in triplicate to 12 the Planning and Community Affairs Agency of the State of Washing - 13 ,ton, along with the population determination of the annexed area 14 as above set forth and further along with a legal description and a map showing specifically the boundaries of the 'annexed territory. 15 Section 7.
