ington, repealing Kent City Ordinance 0.
703 s1--1940 (8.28.28), which established
speed of trains within the City Limits of
4 the City of Kent.
5 WHEREAS, by Ordinance 0.703 s1--1940 (8.28.28), the City Council of the
6 City of Kent established the speed of trains passing through the City of
7 Kent to be a maximum of thirty (30) miles per hour, and
8 WHEREAS, pursuant to the provisions of RCW 81.48.030, the Department
9 of Public Service of Washington, by Order No. FH 7819, dated October 9, 1944,
10 established the maximum speed of trains passing through the City Limits of the
11 ,City of Kent at forty (40) miles per hour, and
12 WHEREAS, the State law supersedes the jurisdiction and the authority of
13 the City of Kent in such matters,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
15
ORDAIN AS FOLLOWS:

Section 1. Kent City Ordinance 0.703 s1--1940 (8.28.28) is hereby
17
repealed.

Section 2. This Ordinance shall take effect.and be in force five (5)
19
;days from and after its passage, approval and publication as provided by law.
