HomeMy WebLinkAbout15711 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 GIG ORDINANCE NO ._Z!2_9 AN ORDINANCE relating to planning and re- zoning for land use and development in the City of Kent, Washington, and rezoning a portion of certain property originally zoned by the City of Kent by Ordinance No. 1071, as amended, as R-1 (Single Family Residential District) zone to R-3 (Multiple Family Resi- dential District) zone. WHEREAS, certain land was origirally zoned by the City of Kent by Ordinance No. 1071, as amended, entitled "Zoning Ordinance for the City of Kent, Washington," passed by the City Council on the 15th day of September, 1960, and WHEREAS, the effective date of the zoning of said certain land by said Ordinance No. 1071 and the effective date of said Ordinance No. 1071, itself, was the 3rd day of October, 1960, and WHEREAS, as required by Ordinance No. 1071, as amended, the City Council, after referral, study by and a public hearing before the Planning Commission of the City of Kent, wherein it was recommended that said land be rezoned from R-1 (Single Family Residential District) zone to R-3 (Multiple Family Residen- I tial District) zone, and WHEREAS, it is found that said rezone is in the best interests of the health, welfare and morals of the Citizens of the City of Kent and is consistent with the comprehensive plan of the City of Kent and consistent with good planning, and WHEREAS, thereafter the City Council of the City of Kent did, upon the 2nd day of December, 1968, hold a public hearing on said recommendation insofar as it related to said certain lands,'said public hearing being held after proper notice thereof, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 I )VT3 ?4f Section 1. The following described land, situated in the City of Kent, County of King, State of Washington, and presently zoned as R-1 (Single Family Residential District) zone and more particularly described as follows: That portion of the S.W. Russell Donation claim lying East of West Line of Section 30, Township 22 North, Range 5E., W.M. in King County, Wash- ington and lying South of the existing Centerline of the existing Right -of -Way known as Titus Pit County Road (Also known as) South 258th St.; Except the West 246 feet thereof is hereby rezoned to R--3(Multiple Family Residential District) zone. Section 2. The City Engineer of the City of Kent be and he is hereby authorized and directed to indicate upon the Comprehensive Planning Map of the City of Kent, or upon an addendum thereto, the zoning of said property as provided for in Section 1 of this Ordinance. Section 3. That upon said amendment being shown upon the Comprehensive Planning Map of the City of Kent, or upon an addendum thereto, the copy of said map or addendum shall be filed with the County Auditor of King County, Washington, and the City Clerk of the City of Kent be and she is hereby authorized and directed to record this Ordinance with the County Auditor of King County and pay the filing fee therefor. Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and pub- lication, as provided by law. Section 5. In conjunction with this rezone application. the Petitioners have submitted to the City of Kent a Quit Claim Deed, deeding to the City of Kent the North 30 feet of the property therein described for additional right-of-way width. The City of Kent herewith accepts that deed and herewith instructs the City Engineer to cause said deed to be recorded in -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 242 the King County Auditor's Office and to pay the recording fee therefor. Section 6. Also, in conjunction with said rezone application, the Petitioners submitted to the City of Kent a letter dated December 17, 1968, which is on file in the City Engineer's Office, and wherein said Petitioners promise in conjunction with said rezone application not to attempt to seek a building permit for or to build upon their real property affected by this rezone until proper arrangements are made to establish a sanitary sewer system to serve said Petitioner's real property. �.
