ORDINANCE NO. &5� c
AN ORDINANCE authorizing and declaring
that certain described land outside the City
of Kent be condemned and purchased for the
purpose of obtaining, the site for construction
of a nr:,,w water ta-111Z.
WH&LIZAS, for the purpose of obtaining the site for
the construction of the proposed five million gallon water tan'lk
number two, it is necessary for the City to acquire land located
outside the City; and

of that necessary land by voluntary conveyance by the owners of
the property involved; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DO
ORDAIN as follows:
Section 1. For the purpose of obtaining the site
for the construction of a new -water tank, there shall be condemned
and purchased outside the boundaries of the City all rights, title
and interests in the folloifing-described property:
The East of the S`J of the NE 14 of the SE'p;
of Section 7, Twp 22 North, !--',5E, W.M. in King
County, 1,61ashington; EXCEPT portion deeded under
Auditor's File No. -106051; being known as Tract
6 UNBEDAN, Orchard Tracts unrecorded.
Section 2. The cost of the condemnation and purchase
of such property shall be paid from the "North Kent Water Con-
struction Fund" of the City, or such other appropriate fund of
the City as the City Council shall later determine.
Section L. The officers and attorneys for the City are
authorized to take the necessary steps to commence and proceed
with the eminent doi-aain
proceedings in accordance with law and to make such necessary
and appropriate modifications in the legal description and
conditions of the taking in 'seeping with the purposes thereof,
and the plans of the City.
Section 4. Nothing in this ordinance shall be
construed as a waiver by the City of hent of its right to
decline to take and pay for said land after the amount of
damages has been ascertained and within the time allowed by
law.
PASSED by the City Council at a regular meeting
thereof and APPROVED by the Mayor of the City of Kent,
Washington, this 2nd day of December, 1963.
