Section 3 of Ordinance No. 1256 (July 21, 11 12 ?.j 1964) (Codified Kent Ordinance 4..24.1 ) which reads as follows: 13 ?, "FEE. Each petition for vacation of a street or alley must be accompanied by a street and 14 alley vacation permit fee of $50.00 and if I such petitioner does not deposit it such sum 15 and/or withdraws his petition, the City Council 1t may then reject the petition and retain the 16 $50.00 street and alley vacation permit fee.", !Hi 17 jhereby amended to read as follows: "FEE. Clerk and the 2 ;'Ordinance vacating such street or alley or a portion thereof 3 4 5 6 7, 8 shall not become effective until such payment has been made. Should the City reserve the right to retain an easement or the right to exercise and grant easements in respect to the land so vacated for theconstruction, repair or maintenance of public utilities and public services, the retention of such an easement, ,if any, shall be duly considered and allowances made therefor in 9 making any such appraisal. 10 Section 3.
