AN ORDINANCE of the City of Kent, Washington, providing for
the condemnation of permanent and temporary construction ease-
ments in, over and upon certain land necessary in connection
with construction and installation of the "North Water System"
.L.I.D. No. 252, and providing further for the payment for
said easements.
The City Council of the City of Kent, Washington, do ordain as follows:
Section 1: That the City Attorney for the City of Kent be and he is hereby
authorized and directed to purchase and/or institute and prosecute to determination
in the Superior Court of the State of Washington, in the County of King, an action
in the name of the City of Kent for condemnation and acquisition of permanent and
temporary construction easements in, over and upon the following described land,
situated in the County of King, State of Washington, for the purpose of obtaining the
necessary property rights for construction and installation of the "North Water System",
L.I.D. No. 252, in the City of Kent, to -wit:
Parcel No. 1 (John Anderson)
The North 1/5 of the South 1/2 of the SW 1/4 of the NW 1/4 of the SE
1/4 of Section 13, Township 22 North, Range 4 East, W.M., in King County,
Washington, EXCEPT the West 490 feet thereof; and EXCEPT the East 30
feet thereof conveyed to King County for road, by deed recorded under
auditor's file No. 2736882.
This easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are
parallel with and Easterly 30 feet and 50 feet respectively, from the
Northerly prolongation of the center line of 4th Avenue North, as shown
on the Plat of Sandwick's Addition to the City of Kent, according to
plat thereof recorded in Volume 59 of Plats, Page 81, Records of
King County, Washington;
TOGETHER WITH a 20 foot temporary construction easement described as
that portion of the above property which lies between lines which are
parallel with and Easterly 10 feet and 30 feet, respectively, from the
Northerly prolongation of the center line of 4th Avenue North, as shown
on said plat of Sandwick's Addition to the City of Kent.
Parcel No. 2 (Dennis Lee Anderson)
The NW 1/4 of the SW 1/4 of the SE 1/4 of Section 13, Township 22
North, Range 4 East, W.M., in King County, Washington, EXCEPT the South
484.5 feet thereof, and EXCEPT the East 20 feet thereof, and EXCEPT the
South 80 feet of the North 100 feet of the East 125 feet thereof.
This easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are parallel
with and Easterly 30 feet and 50 feet respectively, from the northerly
prolongation of the centerline of 4th Avenue North, as shown on the Plat
of Sandwick's Addition to the City of Kent, according to plat thereof
recorded in Volume 59 of Plats, Page 81, Records of King County, Washington.

TOGETHER WITH a 20 foot temporary construction easement described as
that portion of the above property which lies between lines which are
parallel with and Easterly 10 feet and 30 feet, respectively, from the
Northerly prolongation of the centerline of 4th Avenue North, as shown
on said plat of Sandwick's Addition to the City of Kent.
Parcel No. 3 (Bonwell)
The North 102 feet of the South 408 feet of the NW 1/4 of the SW 1/4
of the SE 1/4 of Section 13, Township 22 North, Range 4 East, W.M.;
in King County, Washington, EXCEPT the South 52 feet of the East 147
feet thereof; and EXCEPT the East 20 feet deeded to the City of Kent
for street by instrument recorded under auditor's file No. 2617606.
This easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are parallel
with and Easterly 30 feet and 50 feet respectively, from the Northerly
prolongation of the centerline of 4th Avenue North, as shown on the Plat
of Sandwick's Addition to the City of Kent, according to plat thereof
recorded in Volume 59 of Plats, Page 81, Records of King County,
Washington;
TOGETHER WITH a 20 foot temporary construction easement described as
that portion of the above property which lies between lines which are
parallel with and Easterly 10 feet and 30 feet, respectively, from the
Northerly prolongation of the centerline of 4th Avenue North, as shown
on said plat of Sandwick's Addition to the City of Kent.
Parcel No. 4 (Cole)
The North 1/4 of the South 2/5 of the South 1/2 of the SW 1/4 of the
NW 1/4 of the SE 1/4 of Section 13, Township 22 North, Range 4 East, W.M.,
in King County, Washington, EXCEPT the East 30 feet thereof conveyed to
King County for road, by deed recorded under auditor's file No. 2736882 and
EXCEPT that portion thereof condemned in King County Superior Court
Cause No. 657464 for Primary State Highway No. 5.
This Easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are
parallel with and Easterly 30 feet and 50 feet respectively, from the
Northerly prolongation of the centerline of 4th Avenue North, as shown
on the plat of Sandwick's Addition to the City of Kent, according to
plat thereof recorded in Volume 59 of Plats, Page 81, Records of King
County, Washington;
TOGETHER WITH a 20 foot temporary construction easement described as
that portion of the above property which lies between lines which are
parallel with and Eaterly 10 feet and 30 feet, respectively, from the
Northerly prolongation of the centerline of 4th Avenue North, as shown
on said plat of Sandwick's Addition to the City of Kent.
Parcel No. 5 (Co—Operative Security Corporation)
Tract 8, Supplemental Plat of Meeker's First Addit ion to the Town of
Kent, according to plat recorded in volume 5 of plats, page 96, in
King County, Washington.
This easement consists of a 20 foot permanent strip described as the
East 20 feet of the above property, and the East 401 feet of the South
20 feet of said property.
TOGETHER WITH a 30 foot temporary construction easement described as
the West 30 feet of the East 50 feet of the above property and the
North 30 feet of the South 50 feet of the East 401 feet of said property.

That part of the right of way of Drainage District No. 1 of King
County, which lies within the following:
That part of the Donation Land Claim of Henry Adams designated as
Claim #43 and being parts of Sections 35 h 36, Twp. 23 North, Range
4 East W.M., in King County, Washington, lying South of Orillia
Garden Tracts, according to plat recorded in Vol. 26 of Plats, Page 7,
in King County, Washington, and between the Easterly margin of
Secondary State Highway No. 5-M (known as West Side Highway) and the
Westerly margin of Old Seattle. -Tacoma Interurban right -of -'Way; ALSO:
That part of said Donation Land Claim lying between the Easterly margin
of the Chicago, Milwaukee and St. Paul Railway right- of -away and the
Westerly margin of the Northern Pacific Railroad Company right-of—way.
This easement consists of a 20 foot permanent strip described as the
North 20 f t. of the South 25 ft. of the obeve property.
TOGETHER WITH a 20 foot temporary construction easement described as
the North 20 ft. of the South 45 ft. of the above property.

The North 76.5 feet of the South 484.5 feet of the NW 1/4 of the SW 1/4
of the SE 1/4 of Section 13, Township 22 North, Range 4 East, W;M.,
in King County, Washington, EXCEPT the East 147.50 feet thereof.
This easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are
parallel with and Easterly 30 feet and 50 feet respectively, from the
Northerly prolongation of the centerline of 4th Avenue North, as shown
on the Plat of 'Sandwick's Addition to the City of Kent, according to
plat thereof recorded in Volume 59 of Plat% Page 81, Records of
King County, Washington;
TOGETHER WITH a 20 foot temporary construction easement described as
that portion of the above property which lies between lines which are
parallel with and Easterly 10 feet and 30 feet, respectively, from the

This easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are parallel
with and Easterly 30 feet and 50 feet respectively, from the Northerly
prolongation of the centerline of 4th Avenue North, as shown on the
Plat of Sandwick's Addition to the City of Kent, according to plat thereof
recorded in Volume 59 of Plats, Page 81, Records of King County, Washington;

the East 30 feet thereof deeded to King County for road, by instrument
recorded under auditor's file Nos. 2736882 and 2736884.
This easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are parallel
with and Easterly 30 feet and 50 feet respectively, from the Northerly
prolongation of the centerline of 4th Avenue North, as shown on the Plat
of Sandwick's Addition to the City of Kent, according to plat thereof
recorded in Volume 59 of Plats, Page 81, Records of King County, Washington;
TOGETHER WITH a 20 foot temporary construction easement described as that
portion of the above property which lies between lines which are parallel

Township 22 North, Range 4 East, W.M., in King County, Washington, EXCEPT
the North 86 feet of the South 176 feet of the East 125 feet thereof, and
EXCEPT the South 90 feet of the East 110 feet thereof, and EXCEPT the
North 30 feet thereof, and EXCEPT that portion of the East 30 feet thereof
lying Northerly of the South 176 feet of said subdivision conveyed to
King County for road purposes, by deed recorded under auditor's file No.
2736882, EXCEPT that portion thereof condemned for Primary State Highway
No. 5 (SR 167) in King County Superior Court Cause No. 657464, and EXCEPT

TOGETHER WITH a 20 foot temporary construction easement described as
that portion of the above property which lies between lines which are
parallel with and Easterly 10 feet and 30 feet, respectively, from the

Parcel No. 11 (Morrison)
Blocks 9 and 29, Supplemental Plat of Meeker's First Addition to the
Town of Kent, according to plat recorded in Volume 5 of Plats, Page 960
in King County, Washington; EXCEPT the east 73 feet of the north 73 feet
of said Block 9, as measured along the northerly and easterly lines of
said block.
This easement consists of a 20 foot permanent strip described as the
West 20 ft. of the above property.
TOGETHER WITH a 30 foot temporary construction easement described as
the East 30 feet of the West 50 feet of the above property.

Parcel No. 12 (Pioneer Sand)
The South 600 feet of the NW 1/4 of the SE 1/4 of Section 12,
Township 22 North, Range 4 East, W.M., in King County, Washington,
lying West of the Northern Pacific Railway Company right -of. -way.
This easement consists of a 15 foot permanent strip described as
the East 15 feet cf the West 20 feet of the above property.
TOGETHER WITH a 10 foot temporary construction easement described
as the East 10 feet of the West 30 feet of the above property.
Parcel No. 13 (Pohl)
Lots 15 and 16, Shinn's Valley Ems Addition to Kent according to
plat recorded in Volume 7 of Plats, Page 22, in King County,
Washington.
This easement consists of a 25 foot permanent easement described as
the Southerly 25 feet of the Westerly 30 feet of the above described
property.
Parcel No. 14 (Puget Sound Power & Light Co.)
That portion of the SW 1/4 of Section 36, Twp. 23 North, Range 4 East
W.M., in King County, Washington, described as follows:
A strip of land 100 ft, wide, being 50 ft, in width on each side of the
centerline of the definite location of the Seattle. -Tacoma Interurban
Railway (Now Puget Sound Electric Railway) excluding a strip 14.5 feet
by 121 feet long in the Northwest corner, owned by Mary Johnson), across
a part of henry Adams' Donation Claim in Section 36, Twp. 23 North,
Range 4 EastW.M., said strip of right of way, being more fully described
as follows:
Beginning at the point of intersection of the centerline of definite
location of the Seattle -Tacoma Interurban Railway (Puget Sound Electric
Railway) with the South line of Section 36, Twp, 23 North, Range 4 East
W.M., which is the South line of Henry Adams' Donation Claim, said point
bears south 89°44' West, 557.4 ft. from the Southeast corner of Henry
Adams' Donation Claim or North 89'44' East 1768 ft. from the Southwest
corner of Section 36, Twp, 23 North, Range 4 East W.M.; thence North
89'44* East, 50 ft. to. s point; thence in a Northerly direction 50 ft.
from and parallel to the centerline of the definite location of the
Seattle -.Tacoma Interurban Railway (Puget Sound Electric Railway) as
follows:
Curving to the right by a radius of 11409.2 ft. a distance of 214.8 ft. to
a point; thence North 1'34' East, 3230 ft. to a point; thence curving to
the left by a radius of 11509.2 ft. a distance of 470.9 ft. to a point
on the South line of the County Road through the Town of Orillia; thence
North 89034' West 50 ft.; intersecting the centerline of the definite

Electric Railway), which bears South 86'55' West 461.3 ft. from the
Northeast corner (a stone monument) of henry Adame' Donation Claim;
thence continuing in the same direction 34.7 ft, to the Northeast corner
of Mary E. Johnson's lot; thence South 0'26' West 121 £t, to the Southeast
corner of the said Mary E. Johnson's lot; thence Horth 89'34' West 14 ft.
to a point; thence in a Southerly direction 50 ft, from and parallel to
the centerline of the definite location of the Seattle..Tacoma Interurban
Railway (Puget Sound Electric Railway) as follows:

Curving to the right by a radius of 11409.2 feet a distance of 111409.2

Johnson lot above mentioned is that certain lot of land conveyed to

This easement consists of a 20 foot permanent strip described as the
North 20 feet of the South 25 feet of the above property.

King County, Washington, EXCEPT the East 30 feet thereof heretofore
conveyed to King County for road, by deed recorded under auditor's
file No. 2736882.
This easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are parallel
with and Easterly 30 feet and 50 feet, respectively, from the Northerly
prolongation of the centerline of 4th Avenue North, as shown on the Plat

The South 1/3 of the North 3/5 of the South 1/2 of the SW 1/4 of the
NW 1/4 of the SE 1/4 of Section 13, Township 22 North, Range 4 East,
W.M., in King County, Washington, EXCEPT the East 30 feet thereof
conveyed to King County for road, by deed recorded under auditor's
file No. 2736882, and EXCEPT that portion thereof conveyed to the State
of Washington for highway purposes, by deed recorded under auditor's
file No. 6050788.
This easement consists of a 20 foot permanent strip described as that
portion of the above property which lies between lines which are parallel
with and Easterly 30 feet and 50 feet, respectively, from the Northerly
prolongation of the centerline of 4th Avenue North, as shown on the Plat of
Sandwick's Addition to the City of Kent, according to plat thereof recorded
in Volume 59 of Plats, Page 81, Records of King County, Washington;
TOGETHER WITH a 20 foot temporary construction easement described as
that portion of the above property which lies between lines which are
parallel with and Easterly 10 feet and 30 feet, respectively, from the
Northerly prolongation of the centerline of 4th Avenue North, as shown
on said Plat of Sandwick's Addition to the City of Kent.

Parcel No. 17 (Union Pacific Railroad Co.)
All of vacated McDougall Street in the plat of Orillis Garden Tracts,
according to plat recorded in Volume 26 of Plats, page 7, in King
County, Washington, and that part of the Donation Land Claim of
Henry Adams designated as Claim #43 and being parts of Sections 35
and 26, Township 23 North Range 4 last W.M., in King County, Washington,
lying South of said Orillia Garden Tracts and between the Easterly margin
of secondary State Highway No. 5-M (known as West Side Highway) and
the Westerly margin of old Seattle -Tacoma Interurban right-of-way; ALSO
That part of said Donation Land Claim lying between the Easterly margin
of the Chicago, Milwaukee and St. Paul Railway right. -of -way and the
Westerly margin of the Northern Pacific Railroad Company right-of-way,
EXCEPT that part thereof lying within the right-of-way of Drainage
District No. 1 of King County.
This easement consists of a 20 foot permanent strip described as the
North 20 feet of the South 25 feet of the above property.
TOGETHER WITH a 20 foot temporary construction easement described as
the Noth 20 feet of the South 45 feet of the above property.
Section 2. That the acquiring of said easements for the purpose herein
mentioned is for a public use and necessity.
Section 3. Payment for the easements herein described to be acquired shall
be made from proceeds of a grant from the Economic Development Administration of the
United States Department of Commerce, assessments against the property specially
benefited by the proposed improvements, and water revenue bonds of the City of Kent.
Section 4: Nothing in this Ordinance shall be construed as a waiver by the
City of Kent of the right to decline to take and pay for said easements after the
amount of damages has been ascertained and within the time allowed by law.
Section S. This Ordinance shall take effect and be in force from and after
its passage, approval and publication as provided by laid.
