AN ORDINANCE of the City of Kent, Washington, providing for
the condemnation of permanent and temporary construction ease-
ments in, over and upon certain land necessary in connection
with construction and installation of the "North Sewer System",
U.L.I.D. No. 1 , and providing for the payment for said
easements.
The City Council of the City of Kent, Washington, do ordain as follows:
Section l: That the City Attorney for the City of Kent be and he is hereby
authorized and directed to purchase and/or institute and prosecute to determination
in the Superior Court of the State of Washington, in the County of King, an action in
the name of the City of Kent for condemnation and acquisition of permanent and temporary
construction easements in, over and upon the following described land, situated in the
County of King, State of Washington, for the purpose of obtaining the necessary ates
for construction and installation of a portion of the "North Sewer System", U.L.I.D.
No. I , in the City of Kent, to -wit:
Parcel No. 1 (Barnier)
The NE 1/4 of the SW 1/4 of Section 12, Township 22 North, Range
4 East, W.M., in King County, Washington, EXCEPT that portion thereof
lying within ,the railroad right-of-way and EXCEPT the East 15 feet
thereof conveyed to King County for road purposes by deed recorded
under Auditor's File No. 2295214.
This easement consists of a 65 foot temporary construction easement
described as the West 65 feet of the East 80 feet of the above
described property.
Parcel No. 2 (Barrett)
This easement consists That portion of Tracts 2 and 3, Supplemental Plat of Meeker's First
of a 20 foot perman- Addition to the Town of Kent, according to plat recorded in Vol. 5

common to Sections 13, 14, 23 and 24, said township and range, , the
said point being marked by a round concrete monument and running thence
West along said section line 899.9 ft. to a point on said line marked
by a round concrete monument (being the northeast corner of a tract of
land conveyed to Frances Stewart by deed recorded under Auditor's
File No. 629612); thence South 1359.7 ft. to a round concrete monument
(being the southeast corner of said Frances Stewart tract and the
Northeast corner of a tract of land conveyed to Bessie Stewart
Bereiter by deed recorded under Auditor's File No. 629613 and
also being a point on the centerline of a right-of-way granted to

This easement consists of a 20 foot permanent strip described as that
portion of the above described property which lies Easterly of line
which is parallel with and 20 ft. Westerly, measured radially from

That portion of the WE 1/4 of the NW 1/4 of Section 1, township 22
North, Range 4 East, W.M., in King County, Washington, described
as followst
Beginning at the NW corner of said section; thence North 80'22' East
along the North line of said section 1909.16 feet to the true point
of beginning; thence continuing along said North line North 89"22'
East 436.50 feet to the Westerly line of the Northern Pacific Railway
Right of way; thence South 7.53' East along said Westerly line
786.29 feet; thence South 73'43' West 557.85 feet to the Easterly
line of the Chicago, Milwaukee and St. Paul Railway right of way;
thence North 0'47' West along said Eaterly line 930.04 -feet to the
point of beginning; EXCEPT that portion thereof lying within South
194th Street and EXCEPT any portion lying within drainage ditch

This easement consists of a 20 foot permanent strip described as the
West 20 feet of the East 40 feet (measured at right angles) of the
above described property.
TOGETHER WITH a 160 foot temporary construction easement described
as the East 160 feet (measured at right angles) of the abovedescribed
property.
Said temporary construction easement shall remain in force during
construction and until such time as the sewers and appurtenances have
been accepted for maintenance and operation by the City of Kent.

Parcel No. 7 (Drainage District )
That portion of the right of way of Drainage District No. I of King
County, Washington, which lies within the North 30 feet of the M
1/4 of Section 1, Twp. 22 North, Range 4 Rest W.M., and the South
150 feet of the SW 1/4 of Section 36, Twp. 23 North, Range 4 Rest W.M.
This easement consists of a 5 foot permanent strip described as the
South 5 feet of that portion of the above property which lies within
said Section 36.
This easement also consists of a 15 foot permanent strip described as
the North 15 ft. of that portion of the above property which lies
within said Section 1.
TOGETHER WITH a 30 foot temporary construction easement over the North
30 ft. of Oat portion of the above property which lies within said
Section 1;
AND ALSO:
TOGETHER WITH a 150 foot temporary construction easement over the South
150 ft. of that portion of the above property which lies within said
Section 36.
Parcel No. 8 (Ester)
This Sewer Easement is through Tract 11, O'Brien Station Garden Tracts
No. 2 as recorded in Volume 15 of Plats, Page 66, Records of King
County, Washington.
This easement consists of a 100 ft. temporary construction easement
described as the Easterly 100 ft. in width of the abovedescribed property.
Parcel No. 9 (Hemmingson)
The East one acre of the North 4 acres of Lot 7, Meeker*s Supplemental
Plat of the First Addition to the Town of Kent, according to plat
recorded in Vol. 5 of Plats, Page 95, in King County, Washington,
and further described as follows:
As bounded on the North by Morton Street; bounded on the East by part
of the line between Lots 6 and 7; bounded on the West by part of
the line between the East 1/4 and the West 3/4 of said Lot 7; and
bounded on the South by a line parallel with Morton Street,said
boundary being far enough South of said Morton Street to contain one acre.
This easement consists of a 20 foot permanent strip described as the
East 20 feet of the abovedesecibed property.
TOGETHER WITH a 70 foot temporary construction easement described as
the East 70,feet of the above described property.
Parcel No. 10 (Hilton)
This Sewer Easement is through a portion of Section 1, Township 22
North, Range 4 East W.M., described as follows:
The Southeast 1/4 of the Northmot 1/4 of Section 1, Township 22 North,
Range 4 East, W.M., in King County, Washington; _LESS a right of way
heretofore conveyed to the Puget Shore Railroad Company by a deed
recorded in Volume 23 of deeds, page 702; also 2XCEPT a right of way
therefrom conveyed to the .Seattle -•Tacoma Interurban now known as the
Puget Sound Electric Company, consisting of a strip of land 50 feet
wide on each side of the centerline of the definite location of the
Seattle -Tacoma Interurban Railway across said land, described as follows:

Washington.
This easement consists of a 20 ft. temporary construction easement
described as the West 20 ft. in width of said lots.
Parcel No. 12 (Holst)
This Sewer Easement is through a portion of Tract 10, O'Brien Station
Garden Tracts, as recorded in Volume 12 of Plats, Page 54, Records of
King County, Washington, described as follows:
Beginning at the Southeast corner of said tract; thence Westerly
along the South line of said tract 234.18 feet; thence Northerly to a
point on the North line of said 'tract 176 feet West of the Northeast
corner thereof; thence East to the Northeast corner of said Tract 10;
thence Southeasterly along the Easterly line of said Tract 10 to the
point of beginning.
This easement consists of a 100 ft. temporary construction easement
described as the Easterly 100 ft. in width of the above described property;

This Sewer Easement is through Tax Lot 59 in Section 12, Township 22
North, Range 4 East W.M., said tax lot is described as follows:

All that portion of the Southwest 1/4 of the Northeast 1/4 of Section
12, Township 22 North, Range 4 East, W.M., in King County, Washington,
which lies West of the right-of-way of the Northern Pacific Railroad
company, South of the County Road, (Known as South 212th Street,
O'Brien Road and/or Permanent Highway No. 22)0 and North of a line
described as follows:
Beginning on the east line of said tract 480 feet South of the South
edge of the County Road (O'Brien Road, which is the North boundary
of said Tract) and run at right angles to the Northern Pacific Rail-
way Company's right of way in a Southwesterly direction to the West
Boundary of said tract, EXCEPT road tkow in existance, and EXCEPT the
West 30 feet thereof.
This easement consists of a 40 ft. temporary construction easement

This easement consists of 8100 ft. temporary construction easement

This Sewer Easement is through a portion of Tract 1, O'Brien Station

1120 feet more or less, to the Northwest corner of the tract of land
120 feet by 200 feet in area in the Southwest corner of said Northwest

This easement consists of a 20 ft. temporary construction easement
described as the Westerly 20 ft. in width of said Lots 2 and 3, and
that portion of said Lots A and 1 lying Northerly of the following
described Line "X", and lying Westerly of a line which is Easterly
20 ft., measured at right angles and parallel with the following
described line '"Y":

Beginning at a point on the Easterly line of said Lot "A" which is
Northerly 24 ft., measured along said Easterly line, from the
Southeasterly corner thereof; thence Westerly to a point which is
Northerly 16 ft. measured at right angles, from the Southerly line

This Sewer Easement is through Tract 20, O'Brien Station Garden
Tracts No. 2, as recorded in Volume 15 of Plats, Page 66, Records
of King County, Washington.
This easement consists of a 100 ft. temporary construction easement
described as the Easterly 100 ft. in width of the above described
property.
Parcel No. 19 (Morrison)
Lot 9, Supplemental Plat of Meeker's First Addition to the Town of
Kent, according to plat recorded in Vol. 5 of plats, page 96,
in King County, Washington; EXCEPT the East 73 €t. of the North
73 ft. of said Lot 9, as measured along the Northerly and the
Easterly lines of said Lot.
This easement consists of a 20 ft. permanent strip described as
the Northerly 20 ft. of the above described property; EXCEPT that
portion lying within that certain strip of land set €ooh for
right of way or easement as recorded under auditor's file No.
4772850.
TOGETHER WITH a 50 ft. temporary construction easement described
as the Northerly 50 ft. of the above described property.
Parcel No. 20 (Pollock)
This Sewer Easement is thiough a portion of Section 12, Township 22
North, Range 4 East, W.M., described as follows:
That portion of the Southeast 1/4 of the Northwest 1/4 of Section 12,
Township 22 North, Range 4 East, W.M., in King Cointy, Washington,
lying South of South 212th Street and East of the Chicago, Milwaukee
& St. Paul Railway Company right of way line, EXCEPT the West 60
feet of the North 100 feet thereof, and EXCEPT the mast 15 feet thereof
conveyed to King Cednty for road purposes by deed recorded under
auditor's file No. 1753454, and EXCEPT that portion thereof condemned
for drainage ditch right of way under King County Superior Court
Cause No, 32912.
This easement consists of a 100 ft. temporary construction easement
described as the Easterly 100 ft. in width of the above described
property, which lies South of a line which is Southerly 90 feet, measured
at right angles and parallel with the centerline of South 212th Street
(county road No. 22). This easement replaces easement No. 12-14-250
as recorded under auditor's file No. 6079577.
Parcel No. 21 (Puget Sound Power & Light Co.)
That portion of the SW 1/4 of Section 36, Township 23 North, Range
4 East W.M., in King County, Washington, described as follows:
A strip of land 100 feet wide, being 50 feet in width on each side
of the centerline of the definite location of the Seattle -Tacoma
Interurban Railway (Now Puget Sound Electric Railway) excluding a
strip 14.5 feet by 121 feet long in the Northwest corner, mined by
Mary Johnson), across a part of Henry Adams' Donation Claim in Section
36, Township 23 North, Range 4 East, W.M., said strip of right of way
being more fully described as follows:

This easement consists of a 5 foot permanent strip described as the
South 5 feet of the above property.
This easement also consists of a 15 foot permanent strip described as
the North 15 feet of that portion of the NW 1/4 of Section 1, Towhship
22 North, Range 4 East, W.M., which lies between the Southerly
prolongation of the Westerly and Easterly lines of the above property.

This easement consists of a 20 foot permanent strip described as
the East 20 ft. of the above described property.
TOGETHER WITH a 70 foot temporary construction easement described
as the East 70 ft. of the above described property.
Section 2: That the acquiring of said easements for the purpose herein
mentioned is for a public use and necessity.
Section 3: Payment for the easements herein described to be acquired shall
be made from proceeds of a grant from the Economic Development Administration of the
United States Department of Commerce, assessments against the property specially
funds from the Municipality of Metropolitan Seattle,
benefited by the proposed ismprovementV, and sewer revenue bonds of the City of Kent.
Section 4: Nothing in this Ordinance shall be construed as a waiver by
the City of Kent of its right to decline to take and pay for said easements after the
amount of damages has been ascertained and within the time allowed by law.
Section 5: This Ordinance shall take effect and be in force from and after
its passage, approval and publication as provided by law.
