1 ORDINANCE NO.�
2 AN ORDINANCE of the City of Kent, vacating
certain real property abutting upon a City
3 street or alley within the City Limits of the
City of Kent.

WHEREAS, the owners of more than two-thirds of the
5
following described real property, located in theCity of Kent,
6
County of King, State of Washington, and which is more fully
7
described hereafter, have petitioned the Kent City Council
8
to vacate said real property, and
9
WHEREAS, thereafter, the Kent City Council did, by
10
motion, fix a time when said Petition would be heard and
11
determined by the Kent City Council or a committee thereof, to -
12
wit: Monday, the 19th day of June, 1967, at the hour of 8:00
13
O'clock P.M. in the Council Chambers of the City Hall of the
14
City of Kent, Washington, and
15
WHEREAS, after the passage of said motion, theCity
16
Clerk of the City of Kent gave twenty (20) days notice of the
17
pendency of said Petition by a written notice posted in three
18
of the most public places in theCity of Kent and a like notice
19
in a conspicuous place on the street or alley sought to be
20
vacated; said notice containing the information required therein
21
by the Laws of the State of Washington and the Ordinances of the
22
City of Kent, and
23
WHEREAS, said Petitioners when filing their said Petition
24
25 with the Kent City Clerk, accompanied it with the required street
26 and alley vacation permit .fee of $50.00, and
WHEREAS, the Kent City Engineer has processed said
27
28 Petition and secured the technical facts pertinent to the
29 question of said vacation which includes a sketch of the proposed
30 vacation and also written approval or rejection thereof by the
31 water, sewer and street departments of the City of Kent, and

WHEREAS, thereafter, said Petition, along with said
technical information, was referred to the Planning Commission of
C the City of Kent for consideration at .its next regular meeting;
said Planning Commission recommending favorably on said Petition;
and
WHEREAS, thereafter, the hearing on said Petition was hel
in the Council Chambers of the City Hall of the City of Kent at
8:00 O'Clock P.M. on the 19th. day of June, 1967, and it appear-
ing further that the granting of said Petition for the vacation of
said real property will not be a menace or inconvenience to the
traveling public or to any other persons using the streets and
alleys in the City of Kent, Washington,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That subject to the reservations set forth
in Section2 hereof, the following described real property which
abuts. upon a City street or alley within the City of Kent, Wash-
ington, and which is more fully described herewith:

Washington Central Improvement Company's lst
Addition to Kent.
is hereby vacated and will hereafter belong to.the abutting prop
lowners one-half (1/2) to each.
Section 2. The City of Kent does_ hereby reserve unto itslf,
its successors or assigns, a sewer easement over, under and across
said west 75 feet of alley lying in Block 14,Washington Central
Improvement Company's First Addition to Kent as recorded in Volume
3, page 97, King County, Washington. The benefactors, heirs and
assignees of said 75 feet hereby agree to remove old existing
.sewer line lying within the west 50 feet of said vacated 75 feet
and replace said 50 feet line with an 8 -inch cast iron sewer line.
ALSO, said benefactors, heirs and assignees hereby agree to main -

feet at no cost to the City of Kent.
Section 3. No vested rights shall be affected by the
provisions of this Ordinance.
Section 4. This Ordinance shall take effect and be in
force five days from and after its passage, approval and publica-
tion, as provided by law.
