2 AN ORDINANCE of the City of Kent, vacating
certain real property abutting upon a City
3 Street or alley within the City Limits of
the City of Kent

WHEREAS, the owners of more than two-thirds of the
5
following described real property, located in the City of Kent,
6
County of King, State of Washington, and which is more fully
7
described hereafter, have petitioned the .Kent City Council
8
tovacate said real property, and
9
WHEREAS, thereafter, the Kent City Council did, by
10
motion, fix a time when said Petition would be heard and
11
determined by the Kent City Council or a committee thereof, to -
12
wit: Monday, June 19, 1967, at the hour of 8:00 O'clock P.M. in
13
the Council Chambers of the City Hall of the City of Kent, Wash -
14
ington, and
15
WHEREAS, after the passage of said motion, the City
16
Clerk of the City of Kent gave twenty (20) days notice of the
17
pendency of said Petition by a written notice posted in three
18
of the most public places in the City of Kent and a like notice
19
in a conspicuous place on the street or alley sought to be
20
vacated; said notice containing the information required therein
21
by the Laws of the State of Washington and the Ordinances of the
22
29 question of said vacation which includes a sketch of the proposed
30 vacation and also written approval or rejection thereof by the
31 water, sewer and street departments of the City of Kent, and

WHEREAS,
said Petitioners, when
filing their said

Petition with the
Kent City Clerk, accompanied
it with the
25
required street and
alley vacation permit
fee of $50.00, and
26
WHEREAS,
the Kent City Engineer
has processed said

Petition and secured
the technical facts
pertinent to the
28
29 question of said vacation which includes a sketch of the proposed
30 vacation and also written approval or rejection thereof by the
31 water, sewer and street departments of the City of Kent, and

WHEREAS, thereafter, said Petition, along with said
technical information, was referred to the Planning Commission
of the City of Kent for consideration at its next regular meeting
said Planning Commission recommending favorably on said Petition;
and
WHEREAS, thereafter, the hearing on said Petition was
held in the Council Chambers of the City Hall of the City of Kent
at 8:00 P.M. O'Clock on the 19th day of June, 1967, and it
appearing further that the granting of said Petition for the
vacation of said real property will not be a menace or inconven-
ience to the traveling public or to any other persons using the
streets and alleys in the City of Kent, Washington,
NOW, THEREFORE, THE CITY.COUNCIL OF THE CITY OF KENT,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That subject to the reservations set forth
in Section 2 hereof, the following described real property which
abuts upon a City street or alley within the City of Kent, Wash-
ington, and which is more fully described herewith:
That portion of the SE 1/4 in Section 22,
T 22 N, R4E, W.M., lying within a strip of
land 60 ft. in width, 30 ft. of said width ly-
ing on each side of the following described
center line:
Beginning at a point which is n 6003105" W
2169.09 ft. from the SE corner of said Sec-
tion; thence S 54055100" W 9.76 ft;_ thence
along the arc of a curve to the left with a
radius of 318.46 ft. a distance of 363.61 ft;.
thence S 10032100" E 959.20 ft; thence along
the arc of a curve to the left with a radius
of 143.2.69 ft. a distance of 244.58 ft; thence
S 20019100" E 405 ft. more or less to the East
line of said Section being the terminus of line
herein described.

1 is hereby vacated and will hereafter belong to the abutting
2 property owners one-half (1/2) to each.
3 Section 2. The City does hereby reserve unto itself,
4 its successors or assigns the right to. exercise and grant
3 easements in respect to the vacated land described in Section 1,
6 'hereof for the construction, repair, and maintenance of public
7 utilities and services.
8 Section 3, No vested rights shall be affected by the
9 provisions of this Ordirance.
10 Section 4. This Ordinance shall take effect and be in
11 force five days from and after its passage, approval and publica-
12 tion, as provided by law.
