HomeMy WebLinkAbout1471ORDINANCE No.�--�1 AN ORDINANCE of the City of Kent, Washington, providing for the condemnation of permanent and temporary construc- tion easements in, over and upon certain land necessary in connection with construction and installation of water main designated "South 218th St. Supply Main" and providing further for the payment of said easements. The City Council of the City of Kent, Washington, do ordain as follows: Section I: That the. City Attorney for the City of Kent be and he is hereby authorized and directed to purchase and/or institute and prosecute to determination in the Superior Court of the State of Washington, in the County of King, an action in the name of the City of Kent for condemnation and acquisition of permanent and temporary construction easements in, over and upon the following described land, situated in the County of King, State of Washington, for the purpose of obtaining the necessary area for construction and installation of a water main designated "South 213th St. Supply Main", to -wit: Parcel 18-3 NZ of the SWI of the SE -4 of the NE4 of Section 18; Township 22 North, Range 5 East, W.M., in King County, Washington. This easement consists of a 20 ft. permanent strip, the center- line of which is described as follows: Be inning at the SE corner of the NE4 of said Section 18, thence South 89051'47.9" West 686.45 ft. along the South line of said subdivision; thence North 18049'12.8" West 349.07 ft. to a point on the South line of the above described property and the true point of be¢inning, said point being 506.00 ft. Easterly of the SW corner of said property; thence North 18055102.5" West 349.29 ft. to a point on the North line of the above described property, said point being 386.00 ft. Easterly of the NW corner of said property. TOGETHER WITH a 40 ft. temporary construction easement lying in- side the above described property, the centerline of which is the same as that described above. Parcel 18-5 The 142 of the NW -4 of the SE -14 of the NE4 of Section 18, Township 22 North, Range 5 East, W.M. , in King County, Washington, EXCEPT roads. This easement consists of a 20 ft. permanent strip, the centerline of which is described as follows: Beginning at the SE corner of the NE4 of said Section 18, thence South 89°51'47.9" West 686.45 ft. along the South line of said subdivision; thence North 18049'1.2.8" West 349.07 ft; thence North 18055102.5" West 523.93 ft.; thence North 19°44`23.4" West 175.52 ft. to a point on the South line of the above described - 1 - property and the true point of beginning, said point being 263.33 ft. Easterly of the SW corner of said property; thence continuing North 19044123.4" West 351.05 ft. to a point on the North line of the above described property, said point being 138.00 ft. Easterly of the NW corner of said property. TOGETHER WITH a 40 ft. temporary construction easement lying inside the above described property, the centerline of which is the same as that described above. Parcel 18-6 The W2 of the NE4 of the NE% of Section 18, Township 22 North, Range 5 East, W.M., in King County, Washington, EXCEPT roads. 11 This easement consists of a 20 ft. permanent strip, the centerline of which is described as follows: Beginning at the SE corner of the NE4 of said Section 18, thence South 89051'47.9" West 686.45 ft. along the South line of said subdivision; thence North 18049'12.8" West 349.07 ft.; thence North 18°55102.5" West 523.93 ft.; thence North 19044'23.4" West 526.57 ft. to a point on the South line of the above described property and the true point of beginning, said point being 138.00 ft. Easterly of the SW corner of said property; thence North 17° 59' 13.6" West 420.37 ft. to a point on the West line of the above described property, said point being 400.24 ft. Northerly of the SW corner of said property. TOGETHER WITH a 40 ft. temporary construction easement lying inside the above described property, the centerline of which is the same as that described above. AND ALSO a 10 ft. temporary construction easement described as the Westerly 10 ft. of the Northerly 600 ft. of the Southerly 1,000 ft. of the above described property. Parcel 18-7 East 30 ft. of the E?� of the NW4 of the NE4 of Sectionl8, township 22 North, Range 5 East, W.M., in King County, Washington, EXCEPT the N1-2 of the N1-2 and the S2 of the S2 thereof . This easement consists of a 20 ft. permanent strip, the centerline of which is described as follows: Beginning at the SE corner of the NE4 of said Section 18; thence South 89051'47.9" West 686.45 ft. along the South line of said subdivision; thence North 18049112.8" West 349.07 ft.; thence North 18055102.5" West 523.93 ft.; thence North 19044.23.4" West 526.57 ft.; thence North 17°59'13.6" West 420.37 ft. to a point on the East line of the above described property and the true point of be -inning, said point being 69.46 ft. Northerly of the SE corner of said property; thence continuing North 17059113.6" West 45.72 ft.; thence North 101011.8" East parallel with the Easterly line of the above described property 548.55 ft. to a point on the North line of the above described property, said point being 15.00 ft. Westerly of the NE corner of the above described property. TOGETHER WITH a 30 ft. temporary construction easement described as all of the above described property. - 2 - Section 2: That the acquiring of said easementsf or the purposes herein mentioned is for a public use and necessity, as set forth in Ordinance No. 1408. Section 3: Payment for the easements herein described to be acquired shall. be made partially from proceeds of the sale of Water Revenue Bonds to be issued by the City of Kent, and partially from proceeds of a grant from the Economic Development Admi-nistration of the U.S. Department of Commerce, project No. 07-1-000-99; and pending such sale and the disbursement of the proceeds of such grant, interest bearing war- rants shall be issued by the City of Kent to facilitate payment for the required ease- ments. Section 4: Nothing in this Ordinance shall be construed as a waiver by the City of Kent of its right to decline, to take and pay for said easements after the amount of damages has been ascertained and within the time allowed by law. Section S: This Ordinance shall take effect and bee in force from and after its passage, approval and publication as provided by law.
