2 AN ORDINANCE of the City of Kent, vacating
certain real property abutting upon a City
3 street or alley within the City Limits.of
the City of Kent.

5 WHEREAS, the owners of more than two-thirds of the
following described real property, located in the City of Kent,
7 County of King, State of Washington, and which is more fully
described hereafter, have petitioned the Kent City Council
9 to vacate said real property, and
10 WHEREAS, thereafter, the Kent City Council did, by
11 motion, fix a time when said Petition would be heard and
12
determined by the Kent City -Council or a committee thereof, to -
13 wit: Monday, the 19th day of June, 1967, at the hour of 8:00
14 O'clock P.M. in the Council Chambers of the City Hall of the
City of Kent, Washington, and
15
1.6 WHEREAS, after the passage of said motion, the City.
17 Clerk of the City of Kent gave twenty (20) days notice of the
1.8 pendency of said Petition by a written notice posted in three
19 of the most public places in the City of Kent and a like notice
20 in a conspicuous place on the street or alley sought to be
vacated; said notice containing the information required therein
21
by the Laws of the State of Washington and the Ordinances of the
22
23 City of Kent, and
24
WHEREAS, said Petitioners when filing their said Petition
25
with the Kent City Clerk, accompanied it with the required street
26 and alley vacation permit fee of $50.00, and
27 WHEREAS, the Kent City Engineer has processed said
28 Petition and secured the technical facts pertinent to the
29 question of said vacation which includes a sketch of the proposed
30 vacation and also written approval or rejection thereof by the
31 water, sewer and street departments of the City of Kent, and

1 WHEREAS, thereafter, said Petition, along with said
2 technical information, was referred to the Planning Commission
3 of the City of Kent for consideration at its next regular meeting;

4 said Planning Commission recommending favorably on said Petition;

6 WHEREAS, thereafter, the hearing on said Petition was
7 held in the Council Chambers of the City Hall of the City of Kent
8 at '8:00 O'clock P.M. on the 19th day of June, 1967, and it appear -
9 ing further that the granting of said Petition for the vacation of

said real
property
will not
be a menace or inconvenience to the
11
traveling
public or
to any
other persons using the streets and
12
alleys in
the City
of Kent,
Washington,
13 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT
14 DO ORDAIN AS FOLLOWS:
15 Section 1. That subject to the reservations set forth
16 in Section 2 hereof, the following described real property which
17 abuts upon a City street or alley within the City of Kent,
18 Washington, and which is more fully described herewith:
19 That portion of Smith Street lying west
of Fourth Avenue and east of the east line
20 of Lot 1, Block 2, Rasmussen's Addition
recorded in Volume 14 of plats, page 10,
21 King County, Washington and south of a line
which is 80 feet south of the north line of
22 Smith Street and measured parallel with said
north line.

is hereby vacated and will hereafter belong to the abutting property
24
owners one-half (1/2) to each.

Section 2. The City does hereby reserve unto itself,
--
its successors or assigns the right to exercise and grant ease -
27
28 ments in respect to the vacated land described in Section 1
29 hereof for the construction, repair and maintenance of public
utilities and services.

31 Section 3. No vested rights shall be affected by the
32 provisions of this Ordinance.

Section 4. This Ordinance shall take effect and be in

force five days from and after its passage, approval and publica-
3
tion, as provided by law.
