AN ORDINANCE of the City of Kent, vacating certain real propetty abutting upon a city street or alley within the City Limits of the City of Kent. WHEREAS, the owners of more than two-thirds of the following described real property, located in the City of Kent, County of King, State of Washington, and which is more fully described hereafter, have petitioned the Kent City Council to 9 vacate said real property, and 10 WHEREAS, thereafter, the Kent City Council, did, by 11 otion, fix a time when said Petition would be heard and determined 12 by the Kent City Council or a committee thereof, to -wit: Monday, 13 the 5th day of December, 1966, at the hour of 8:00 p.m., in the 14 Council Chambers of the City Hall of the City of Kent, Washington, 15 land 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 WHEREAS, after the passage of said motion, the City Clerk f the City of Kent gave twenty (20) days notice of the pendency f said Petition by a written notice posted in three of the most ublic places in the City of Kent and a like notice in a con- picuous place on the street or alley sought to be vacated; said otice containing the information required therein by the laws of he State of Washington and the Ordinances of the City of Kent, and WHEREAS, said Petitioners when filing their said petition ith the Kent City Clerk, accompanied it with the required street nd alley vacation permit fee of $50.00, and WHEREAS, the Kent City Engineer has processed said etition and secured the technical facts pertinent to the question of said vacation which includes a sketch of the proposed vacation and also written approval or rejeetion thereof by the water, sewer and street departments of the City of Kent, and WHEREAS, thereafter said Petition, along with said -1- V` N n OO N 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 22 technical information, was referred to the Planning.Commission of the City of Kent for considepation at its next regular meeting, said Planning Commission recommending favorably on said Petition; and WHEREAS, thereafter the hearing on said petition was held in the Council Chambers of the City Hall of the City of Kent at 8:00 p.m. on the 5th day of December, 19665 and it appearing furthe that the granting of said Petition for the vacation of said real property will not be a menace or inconvenience to the traveling public or to any other persons using the streets and alleys in the City of Kent, Washington, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT DO ORDAIN AS FOLLOWS: Section 1. That subjecT 'co zne din Section 2 hereof, the following described real property which abuts upon a city street or alley within the City of Kent, Wash- ington, and which is more fully described herewith: City of Kent, County of King, State of Washington: That portion of S. 181st Street lying West of Puget Sound Electric Railway and East of the East line of 72nd Avenue South in Henry Adams Donation Claim in Section 36, Township 23 N, Range 4 E., W.M., King County, is hereby vacated and will hereafter belong to the abutting prop- lerty owners one-half (1/2) to each. i Section 2. The City does hereby reserve unto itself, its successors or assigns the right to exercise and grant easement in respect to the vacated land described in Section 1 hereof for the construction, repair, and maintenance of public utilities and services. Section 3. No vested rights shall be affected by the provisions of this Ordinance. Section 4.
