L� AN ORDINANCE of the City of Kent, vacating certain real property abutting upon a City street or alley within theCity Limits of the City of Kent. WHEREAS, the owners of more than two-thirds of the following described real property, located in the City of Kent, County of King, State of Washington, and which is more fully described hereafter, have petitioned the Kent City Council to vacate said real property, and WHEREAS, thereafter the Kent City Council did, by motion, fix a time when said Petition would be heard and determined by the Kent City Council or a committee thereof, to -wit: Monday, the 17th day of October, 1966, at the hour of 8 o'clock p.m. in the Council Chambers of the City Hall of the City of Kent, Washington, and WHEREAS, after the passage of said motion, the City Clerk of the City of Kent gave twenty (20) days notice of the pendency of said Petition by a written notice posted in three of the most public places in the City of Kent and a like notice in a conspicuous place on the street or alley sought to be vacated; said notice containing the information required therein by the la of the State of Washington and the Ordinances of the City of Kent, and WHEREAS, the Kent City Engineer has processed said Petition and secured the technical facts pertinent to the question of said vacation which includes a sketch of the proposed vacation and also written approval or rejection thereof by the water, sewer and street departments of the City of Kent, and WHEREAS, thereafter said Petition, along with said technical information, was referred to the Planning Commission -1- 1 2 3 P, I,-- -0 5 �0 6 tp R. 7 Ln 1`- 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 of the City of Kent for consideration at its next regular meeting; said Planning Commission recommending favorably on said Petition; and WHEREAS, thereafter the hearing on said Petition was held in the Council Chambers of the City Hall of the City of Kent at 8 o'clock pm on the 17th day of October, 1966, and it appearing further that the granting of said Petition for the vacation of said real property will not be a menace or inconvenience to the traveling public or to any other persons using the streets and alleys in the City of Kent, Washington. NOVO THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT DO ORDAIN AS FOLLOWS: Section 1. That subject to the reservations set forth in Section 2 hereof, the following described real property which abuts upon a city street or alley within the City of Kent, Washington, and which is more fully dee- cribed as follows: A portion of Lincoln Avenue as platted in Washington Central Improvement Companies Knob Hill Addition to Kent, Washington, recorded in Vol. 3 of Plats, page 97, records of King Countys Washington more particularly des"ribed as follows: The South 125 ft. of Lincoln Avenue lying between Block 29 and Block 30, The North 125 ft. of Lincoln Avenue lying between Block 29 and B1ock.30 except a 20 ft. wide strip the C/L of which lies 2 ft. West of the platted C/L of Lincoln Ave. and except a portion described as follows: Beginning at the SW corner of Lot 20 Block 30; thence westerly along the South line of said Lot 20 projecting West a distance of 22 ft; thence northerly parallel with Lincoln Avenue a dis- tance of 22ft; thence southeasterly to beginning, lis hereby vacated and will hereafter belong to the abutting property owners lone -half (1/2) to each. Section 2• The City does hereby reserve unto itself, its suo- Jcessors or assigns the right to exercise and grant easements in respect to the vacated land described in Section 1 hereof for the construction, repair, Jand maintenance of public utilities and services. Section 3. No vested rights shall be affected by the provisions Iof this ordinance. "2.
