ORDINANCE NO. �
\ AN ORDINANCE of the City of Kent vacating
certain real property located within a city
street or alley within theCity Limits of
the City of Kent.
WHEREAS, the owners of more than two-thirds of certain
real property which abutts upon a city street or alley located in
the City of Kent, County of King, State of Washington, and which
is more fully described hereafter, have petitioned the Kent
City Council to vacate said real property, and
WHEREAS, thereafter the Kent City Council did, by
motion, fix a time when said Petition would be heard and
determined by the Kent City Council or a committee thereof, to -wit
Monday, the 17th day of October, 19665 at the hour of 8 o'clock
p.m. in the Council Chambers of the City Hall of the City of
Kent, Washington, a date which was not more than sixty (60) days
nor less than twenty (20) days after the date of the passage of
(said Motion, and
WHEREAS, after the passage of said motion, the City
Clerk of the City of Kent gave twenty (20) days notice of the
pendency of said Petition by a written notice posted in three of
the most public places in the City of Kent and a like notice in
a conspicuous place on the street or alley sought to be vacated;
said notice containing the information required therein by the
laws of the State of Washington and the Ordinances of the City
hof Kent, and
WHEREAS, the Kent City Engineer has processed the said
Petition and secured the technical facts pertinent to the question

1 of said vacation which includes a sketch of the proposed vacation
2 and also written approval or rejection thereof by the water, sewer
3 and street departments of the City of Kent, and
4 WHEREAS, thereafter said Petition along with said
5 technical information, was referred to the Planning Commission
6 of the City of Kent for consideration at its next regular meeting;
7 said Planning Commission recommending favorably on said Petition,
8 1and
9 WHEREAS, thereafter the hearing on said Petition was
10 held in the Council Chambers of the City Hall of the City of Kent
11 at 8 o'clock p.m. on the 17th day of October, 1966 and it appearing
12 further that the granting of said Petition for the vacation of a
13 portion of said real property will not be a menace or inconvenience
14 to the traveling public or to any other persons using the streets
lb and alleys in the City of Kent, Washington.
16 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT DO
17 ORDAIN AS FOLLOWS:
18 Section 1. That subject to the reservations set forth
19 in Section 2 hereof, the following described real property which
20 is within a city street or alley within theCity of Kent, Washington
21 land which is more fully described herewith:
22 That portion of Walnut St. from the W margin of
23 Tilden Ave. as platted in Washington Central
Improvement Company's Knob Hill Addit9on records
24 as recorded in Vol. 3 of Plats, page,
of King County, Washington, to the southerly
25 projection of the Northeasterly line of Woodland
Way as platted in Armscrest No. 5 Addition to
26 Kent, recorded in Vol. 78 of Plats, page 86,
records of King County, Washi.ngtons
27 s hereby vacated and will hereafter belong to the abutting propert
28 wners one-half (1/2) to each.
29 Section 2. That the City does hereby reserve unto itself
30 its successors and assigns, the right to exercise and grant ease -
31 ents in respect to the vacated land described in Section 1 hereof,

for the construction, repair, and maintenance of public utilities
and services.
Section 3. No vested rights shall be affected by the
Provisions of this Ordinance.
Section 4. This Ordinance shall take effect and be in
force from and after its passage, approval and publication as
provided by law.
