ORDINANCE No. Z135P_
AN ORDINANCE of the City of Kent, Washington, providing for
the condemnation of permanent and temporary construction ease-
ments in, over and upon certain land necessary in connection
with construction and installation of a portion of the "North
Sewer System", L.I.D. No. 250, and providing for the payment
for said easements.
The City Council of the City of Kent, Washington, do ordain as follows:
Section 1 : That the City Attorney for the City of Kent be and he is hereby
authorized and directed to purchase and/or institute and prosecute to determination
in the Superior Court of the State of Washington, in the County of King, an wit

in the name of the City of Kent for condemnation and acquisition off4emporary cons-
truction easements in, over and upon the following described land, situated in the
County of King, State of Washington, for the purpose of obtaining the necessary area
for construction and installation of a portion of the "North Sewer System", L.I.D.
No. 250, in the City of Kent, to -wit:
Parcel 13-22
That portion of the Nil of the NE4 of Section 13, Twp. 22 North,
Range 4 East W.M., in King County, Washington, lying East of the
right of way of Northern Pacific Railway, EXCEPT the following
described tract:
Beginning at the Northeast corner of the above described property;
running thence West 30 feet; thence South 60 feet to the true point
of beginning; running thence West 315 feet; thence South 720 feet;
thence East 315 feet to the West line of 84th Avenue South; thence
North 720 feet to the true point of beginning (all directions being
parallel with the North and East lines of said Sec. 13), and EXCEPT
the East 30 feet of said N3rz of the NE4 conveyed to King County for
road by deeds recorded under auditor's file Nos. 749612 and 749620,
and EXCEPT that portion thereof condemned for Primary State Highway
No. 5 in King County Superior Court cause No. 587053, and EXCEPT
that portion thereof lying within South 228th Street.
This easement consists of a 10 foot permanent strip described as
the South 10 feet of that portion of the above described property
lying West of the Westerly margin of Primary State Highway No. 5 -
SR 167, as shown on Sheet 10 of 18, and approved May 4, 1965.
TOGETHER WITH a 30 foot temporary construction easement described
as the South 30 feet of that portion of the above described property
lying West of the Westerly margin of Primary State Highway No. 5 -
SR 167, as shown on Sheet 10 of 18, and approved May 4, 1965.
This easement also consists of a 20 foot permanent strip described
as the North 60 feet of the East 20 feet of that portion of the above
described property which adjoins the North line of said Section 13.

Parcel 14-1
The NE 4 of the NE 4 of Section 14, Township 22 North, Range 4
East W.M., in King County, Washington, EXCEPT the East 30 feet
thereof conveyed to King County for road by deed recorded under
auditor's file No. 602288 and EXCEPT that portion thereof lying
within South 228th (Taylor Road) and EXCEPT that portion thereof
condemned for drainage ditch right of way in King County Superior
Court Cause No. 32912.
This easement consists of a 20 foot permanent strip described as
the East 20 feet of the above described property.
TOGETHER WITH a 75 foot temporary construction easement described
as the East 75 feet of the above described property.
Parcel 14-8
Government lot 6, section 14, township 22 north, range 4 east,
W,M., in King County, Washington.
This easement consists of a 15 foot permanent strip described as
the westerly 15 feet of the above described property.
Together with a 75 foot temporary construction easement described
as the westerly 75 feet of the above described property.
Parcel 14-3
The NE4 of the SE4 of Section 14, Township 22 North, Range 4 East
W.M., in King County, Washington, EXCEPT the East 30 feet thereof
conveyed to King County for road by deed recorded under auditor's
file No. 602278, and EXCEPT that portion thereof condemned for
drainage ditch right of way in King County Superior Court Cause
No. 32912; and EXCEPT that portion thereof conveyed to Drainage
District No. 1 by deed recorded under auditor's file No. 4806961.
AND - the SE4 of the NE4 of Section 14, Township 22 North, Range
4 East W.M., in King County, Washington, EXCEPT the North 229 feet
of the East 224 feet thereof; and EXCEPT the East 30 feet thereof
conveyed to King County for road by deed recorded under auditor's
file No. 602278; and EXCEPT that portion condemned for drainage
ditch right of way in King County Superior Court Cause No. 32912;
and EXCEPT that portion thereof conveyed to King County Drainage
District No. 1, by deed recorded under auditor's file No. 4806961.
This easement consists of a 20 foot permanent strip the Easterly
line being described as follows: Beginning at the intersection of
the South line of the NE4 of the SE4 of said Sec. 14 with the West
line of the East 30 feet thereof; thence Northwesterly to the South-
west corner of a tract of land conveyed to King County Drainage Dis-
trict No. 1 by deed recorded under Auditor's File No. 4806961; thence
Northerly along the West line of said Tract of land conveyed to King
County Drainage District to the Northwest corner thereof; thence
Northeasterly to a point on the West line of the East 30 feet of
said Sec. 14 which is Southerly 329 feet from the North line of the
SE4 of the NE4 thereof; thence Northerly along said West line to the
South line of the North 229 feet of the SE4 of the NE4 of said Sec.
14.
TOGETHER WITH a temporary construction easement over that portion of
said Sec. 14 between the West line of the East 30 feet thereof and
the East line of the above described 20 foot permanent strip;
EXCEPT that portion thereof conveyed to Drainage District No. 1 by
deed recorded under auditor's file No. 4806961.

Parcel 2-2:.
The NE4 of the NE4 and that portion of Government Lot 1, in Section
2, Twp. 22 North, Range 4 East W.M., in King County, Washington,
lying Easterly of Green River; EXCEPT the East 30 feet thereof con-
veyed to King County for road by deed recorded under Auditor's File
No. 602270, and EXCEPT those portions thereof lying within South
196th Street and Russel Road.
This easement consists of a 20 foot permanent strip described as the
North 20 feet of the East 15 feet of the above described property.
This easement also consists of a 30 foot permanent strip described
as the West 30 feet of the East 45 feet of the above described pro-
perty.
TOGETHER WITH a 140 foot temporary construction easement described
as the East 140 feet of the above described property.
Parcel 35-1
The South 420 feet of that portion of the Donation Land Claim of
Henry Adams designated as Claim No. 43 and being parts of Section 35
and 36, township 23 north, range 4 east, W.M., in King County,
Washington, lying between Permanent Highway No. 3 as established and
used on April 25, 1922 and the meander line of White River.
This easement consists of a 10 foot permanent strip described as the
South 10 feet of that portion of the East 75 feet of the SE14 of said
Section 35 lying West of said highway.
TOGETHER with a 150 foot temporary construction easement described
as the South 150 feet of that portion of the East 170 feet of the
SEs✓ of said Section 35 lying West of said highway.
Parcel 12-9
Tracts 13 and 14, Shinn's Valley Home Addition to Kent, according to
plat recorded in Volume 7 of plats, Page 22, in King County, Washington.
This easement consists of a 15 foot permanent easement described as
the Northerly 15 feet in width of the above described property.
TOGETHER WITH a 30 foot temporary construction easement described as
the Northerly 30 feet in width of the above described property.
And a 10 foot temporary construction easement described as the Westerly
10 feet in width of the above described property.
Parcel 12-15
That portion of the SES of the SW14 of Section 12, Township 22 North,
Range 4 East W.M., in King County, Washington, described as follows:
Beginning at the intersection of the North line of said subdivision
and the East right-of-way line of the Chicago, Milwaukee and St. Paul
Railroad; thence East along said North line 230.96 feet; thence South
to a point that is 230.96 feet East along the south line of said sub-
division, from the Chicago, Milwaukee and St. Paul Railroad right-of-
way; thence West 230.96 feet along said South line of said sub -division
to the intersection of railroad right-of-way; thence North along the
railroad right-of-way to the true point of beginning.
This easement consists of a 20 foot permanent strip described as the
North 20 feet of the South 530.4 feet of the above described property.
TOGETHER WITH a 60 foot temporary construction easement over the North
60 feet of the South 555.4 feet of the above described property.

Beginning at a point on the North line of said subdivision 230.96
feet East of the East line of the right-of-way of the Chicago, Mil-
waukee, St. Paul and Pacific Railroad; thence East along said North
line to the Northeast corner of said subdivision; thence South along
the East line of said subdivision to the Southeast corner thereof;
thence West along the South line of said subdivision to a point 230.96
feet East of said right-of-way; thence North to the point of beginning;
EXCEPT that portion thereof condemned in King County Superior Court
Cause No. 32912 for Drainage District No. 1 ditch;
This easement consists of a 15 foot permanent strip described as the
East 15 feet of the above described property and the North 15 feet of
the above described property; and a 20 foot permanent strip described
as the North 20 feet of the South 530.4 feet of the above described
property.
TOGETHER WITH a 60 foot temporary construction easement over the North
60 feet of the South 555.4 feet of the above described property, and
a 30 foot temporary construction easement described as the East 30
feet and the North 30 feet of the above described property.

The East 495 feet of the SW14 of the NE4 of Section 13, Township 22
North, Range 4 East W.M., in King County, Washington;
EXCEPT the South 300 feet of the North 350 feet of the East 150 feet
of the West 180 feet thereof;
and EXCEPT the Northern Pacific Railroad right-of-way.
This easement consists of a 5 foot permanent strip described as the
South 5 feet in width of the above described property.
TOGETHER with a 30 foot temporary construction easement described as
the Wouth 30 feet of the above described property.
Parcel 13-20
The W-2 of the NWA of the SFr in Section 13, Township 22 North, Range 4
East W.M., in King County, Washington;
EXCEPT the South 30 feet of the NWA of the NWA of the SE4 and the West
30 feet of the South 30 feet of the NE4 of the NWA of the SFr of said
Section 13 heretofore conveyed to King County for road purposes by
deeds recorded under Auditor's File Nos. 2736881 and 2736886, in King
County, Washington.
AND that portion of the NW14 of the NE4 of the SEA lying West of the
right-of-way of the Northern Pacific Railway Company; in Section 13,
Township 22 North, Range 4 East W.M., in King County, Washington.
This easement consists of 15 foot permanent strip described as the
North 15 feet of the above described property.
TOGETHER with a 30 foot temporary construction easement described as

This easement consists of a 15 foot permanent strip described as the
East 15 feet of the above described property.
TOGETHER with a temporary construction easement over the East 30 feet
of the above described property.
Parcel 13-49
That portion of the NE4 of the SW14 of Section 13, Township 22 North,
Range 4 East W.M., in King County, Washington, lying East of the
right-of-way of the Chicago, Milwaukee and St. Paul Railroad;
EXCEPT the East 60 feet deeded to King County for road by deeds re-
corded under Auditor's File Nos. 2736883 and 2736885; and
EXCEPT the following described tract:
The S'i of the S'g of that portion of the NE4 of the SW14 of Section 13,
Township 22 North, Range 4 East W.M., in King County, Washington,
lying East of the right-of-way of the Chicago, Milwaukee and St. Paul
Railroad;
EXCEPT the East 60 feet deeded to King County for road.
This easement consists of a 15fbot permanent strip described as the
North 15 feet of the East 345 feet of the above described property.
TOGETHER with a 30 foot temporary construction easement described as

The East 330 feet of the Southeast quarter of the Northwest quarter;
and the West 330 feet of the Southwest quarter of the Northeast quarter;
ALL in Section 13, Township 22 North, Range 4 East, W.M., in King
County, Washington;
EXCEPT the county road along the North end thereof.
This easement consists of a 20 foot permanent strip, the centerline of
which is described as follows:
Beginning at the Northeast corner of the SE -4- of the NW4 of said Sec-
tion 13; thence North 88036'44" West along the North line of said sub-
division 5.00 feet; thence South 1010'06" West parallel with the East
line of said subdivision 20.00 feet to the true point of beginning;
thence continuing South 1010'06" West 267.60 feet; thence South 34044'18"
East 496.00 feet; thence South 17033'37" East 202.58 feet; thence South
1015'42" West 465.00 feet to the South line of said SE4 of the NW -4;
except any portion thereof lying East of the East line of said SFr of

Together with a 60 foot temporary construction easement of which 35 feet

This easement consists of a 20 foot permanent strip, the centerline of
which is described as follows: Beginning at a point on the South line
of the above described property which is South 88045'54" East 350.16
feet from the center of said Section 13; thence North 1015'42" East
465.00 feet; thence North 17033'37" West 70 feet, more or less, to
the West line of the above described property.
TOGETHER with a 60 foot temporary construction easement of which 35
feet in width lies Easterly and 25 feet in width lies Westerly of the
above described centerline; EXCEPT any portion thereof lying Westerly
of the Westerly line of said Southwest quarter of the Northeast quarter.
Also, a 5 foot permanent strip described as the South 5 feet of the
above described property.

This easement consists of a 20 foot permanent strip described as
the easterly 20 feet in width of the above described property.

The south 292.71 feet of Government Lot 2, section 18, township 22
north, range 5 east, W.M., in King County, Washington, EXCEPT the
south 40 feet of the east 40 feet thereof, and EXCEPT that portion
thereof conveyed to King County for road by deed recorded under
auditor's file No. 791775, and EXCEPT that portion thereof condem-
ned for drainage ditch under King County Superior Court Cause
No. 32912.
This easement consists of a 20 foot permanent strip described as
that portion of the above described property which lies westerly
of a line which is parallel with and 20 feet easterly from the

This easement consists of a 20 foot permanent easement described as the
Easterly 20 feet in width of the above described property.
Parcel 12-4
The S2 of Tract 3, Shinn's Valley Home Addition to Kent,according to
plat recorded in Volume 7 of Plats, Page 22, in King County, Washington.
This easement consists of a 20 foot permanent easement described as the
Easterly 20 feet in width of the above described property.
AND ALSO a 10 foot permanent easement described as the Southerly 10 feet
in width of the above described property.
TOGETHER WITH a 30 foot temporary construction easement described as the
Woutherly 30 feet of the above described property.
Parcel 1-22
The West 5 acres of the S2 of the NE4 of the SE4 of Section 1, Twp. 22
North, Range 4 East W.M., in King County, Washington, EXCEPT that portion
thereof lying within the drainage ditch which intersects the east bound-
ary line approximately 40 feet north of the Woutheast corner thereof and
runs in a Northwesterly direction, and EXCEPT any portion of said premises
lying within 80th Ave. South.
This easement consists of a 5 foot permanent strip described as the West
5 feet of the above described property.
TOGETHER WITH a 30 foot temporary construction easement described as the
West 30 feet of the above described property.
Parcel 13-25
That portion of the NW% of the SW14 of Section 13, Township 22 North,
Range 4 East W.M., in King County, Washington, described as follows:
Beginning at the Northwest corner of the SW14 of the NWS of said Section;
thence South 1055.43 feet along the center line of county road to true

ginning; EXCEPT the West 30 feet thereof for Road.
This easement consists of a 20 foot permanent strip described as the
West 20 feet of the above described property.

That portion of the NW14 of the SW14 of Section 13, Township 22 North,
Range 4 East, W.M., in King County, Washington, described as follows:
Commencing at the Northwest corner of the SW14 of the NW14 of said Section
13, thence South 1453.82 feet along the center line of paving to the
True Point of Beginning; thence East 678.17 feet; thence South 125.53
feet; thence West 678.17 feet; thence North 125.53 feet to the Point of
Beginning; EXCEPT the West 30 feet thereof, lying within 68th Avenue
South. (Being known as Tract 2, Kent Subdivision Company, according to
the unrecorded plat).
This easement consists of a 20 foot permanent strip described as the
west 20 feet of the above described property.
Parcel 13-8
The north 225 feet of the south 703.4 feet of that portion of the north-
east quarter of the southeast quarter of section 13, township 22 north,
range 4 east, W.M., in King County, Washington, lying between the Northern
Pacific Railroad right of way and State Highway No. 5, and lying south of
a line bearing north 89056'13" west from a point on the east line of said
section 13, said point being south 727.24 feet from the northeast corner
of said southeast quarter of section 13.
This easement consists of a 20 foot permenent strip described as the east-
erly 20 feet in width of the above described property.

That portion of the SW14 of the SW14 of Section 1, township 22 North, Range
4 East W.M., in King County, Washington, described as follows:
Beginning 862 feet North of the Southwest corner of said Section; thence

This easement consists of a 20 foot permanent strip &scribed as the West
20 feet of the above described property, and a 15 foot permanent strip

That portion of the Donation Land Claim of David A. Neely, Claim No. 37,
being parts of Sections 10, 11, 14 and 15, Township 22 North, Range 4
East W.M., in King County, Washington, described as follows:
Beginning at the Northeast corner of Government Lot 5, said Section 14;
