HomeMy WebLinkAbout13641 N 2 J C 3 Cj 4 t� }. 5 8 7 8 9 10 11 12 13 14 15 16 I 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 3'2 ORDINANCE NO. _AaiY AN ORDINANCE of the City of Kent, vacating certain real property abutting upon a City street or alley within the City Limits of the City of Kent WHEREAS, the owners of more than two-thirds of the following described real property, located in the City of Kent, County of King, State of Washington, and which is more fully described hereafter, have petitioned the Kent City Council to vacate said real property, and WHEREAS, thereafter, the Kent City Council did by Resolution fix a time when said petition would be heard and determined by the Kent City Council or a committee thereof, to - wit: Monday, the 16th day of May, 1966, at the hour of 8:00 o'clock P.M. in the Council Chambers of the City Hall of the City of Kent, Washington, and WHEREAS, after the passage of said Resolution, the City Clerk of the City of Kent gave twenty ( 2 0 ) days notice of. the pendency of said Petition by a written notice posted in three of the most public places in the City of Kent and a like notice in a conspicuous place on the street or alley sought to be vacated; said notice containing the information required therein by the Laws of the State of Washington and the Ordinances of the City of Kent, and WHEREAS, said petitioners when filing their said petition with the Kent City Clerk, accompanied it with the required street and alley vacation permit fee of $50.00, and WHEREAS, the Kent City Engineer hasprocessed said petition and secured the technical facts pertinent to the question of said vacation which includes a sketch of the proposed vacation and also written approval or rejection thereof by the water, sewer and street departments of the City of Kent, and -1- 1 WHEREAS, thereafter said petition along with. said 2 technical information, was referred to the planning commission 3 of the City of Kent for consideration at its next regular meeting; 4 said planning commission recommending favorably on said petition; 5 and 6 WHEREAS, thereafter the .hearing on said petition in the 7 Council Chambers of the :City Hall of the City of Kent .at 8:00 8 o'clock P.M. on the l6th day of May, 1966, and it appearing 9 further that the :granting of said petition for the vacation of 10 said real property will not be a menace or inconvenience to the 11 traveling public or to any other persons using the streets and 12 alleys in the City of Kent, Washington, 13 NOW,. THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT 14 DO ORDAIN AS FOLLOWS: 15 Section 1. That subject to the reservations set forth 16 in Section 2 hereof, the following described real property which 17 abuts upon a city street or alley within the City of Kent, 18 Washington, and which is more fully described herewith: 19 City of Kent, County of King, State.of Washington: 20 That portion of Cedar Street as shown on Sunny- side Addition to Kent as recorded in Volume 18 of 21 Plats, page 66, records of King County, Wash- ington lying easterly of the arc of a circle having 22 a radius of 50. feet, the center of which circle lies on the center line of said Cedar Street 157 feet 23 westerly from the East end of said Street., EXCEPT that the City of Kent retains an easement for 24 ingress, egress and utility purposes over, under and across that portion of the above. description 25 lying 20 feet North of and 10 feet South of the centerline of said Cedar Street; also Sunnyside 26 Avenue and an unnamed. Avenue adjacent to the East line of. Block. 2, both as shown on S. G. Mickelson's 27 Sunnyside Addition as recorded in 'Volume 45 of Plats, page 23, Records of King County, Washington lying 28 South of the South line of James Street and North of the North line of Cedar Street. 29 is hereby, vacated and will hereafter belong to the abutting 30 property owners one-half (1/2) to each. 31 Section 2. Section 3. No vested rights shall be affected. by the provisions of this Ordinance Section 4. This Ordinance shall take effect and be in force five (5) days from and after .its passage, approval and publication, as prtviAed`by law. :+.
