HomeMy WebLinkAbout1346ORDINANCE N0..3L Y6 AN ORDINANCE of the City of Kent, Washington, providing for the condemnation of temporary construction easements in, over and upon certain land necessary in connection with construction and installation of a portion of the "North Sewer System", L.I.D. No. 250, and providing for the payment for said easements. The City Council of the City of Kent, Washington, do ordain as follows: Section 1: That the City Attorney for the City of Kent be and he is hereby authorized and directed to purchase and/or institute and prosecute to determina- tion in the Superior Court of the State of Washington, in the County of King, an action in the name of the City of Kent for condemnation and acquisition of temporary construction easements in, over and upon the following described land, situated in the County of King, State of Washington, for the purpose of obtaining the necessary area for construction and installation of a portion of the "North Sewer System", L.I.D. No. 250, in the City of Kent, to -wit: The West 100 feet of the easterly 130 feet of the Southwest Quarter of the Northeast Quarter, Section 11, Township 22 North, Range 4 East, W.M., all situate in King County, State of Washington. Section 2: That the acquiring of said easements for the purpose herein mentioned is for a public use and necessity. Section 3: Payment for the easements herein described to be acquired shall be made from the current expense fund of the City of Kent. Section 4: Nothing in this Ordiance shall be construed as a waiver by the City of Kent of its right to decline, to take and pay for said easements after the amount of damages has been ascertained and within the time allowed by law. Section 5: This Ordinance shall take effect and be in force from and after its passage, approval and publication as provided by law.
