ORDINANCE NO.�1 _
AN ORDINANCE of the City of Kent approving and
confirming the assessments and assessment roll
of L.I.D. No. 246, for the improvement of cer-
tain streets and avenues within the City, by
the construction and installation of water mains
along with gate valves, fittings and other neces-
sary appurtenances, and by doing all other work
necessary in connection therewith and incidental
thereto; levying and assessing the amount thereof
against the several lots, tracts, parcels of land
and other property as shown on said assessment
roll; providing for the payment of said assess-
ments into Local Improvement District No.
Fund, created by Ordinance No. 1259 of the City;
and declaring an emergency.
WHEREAS, by motion duly made, seconded and passed, the
City Council fixed the date, time,and place of the hearing on the
assessment roll for Local Improvement �4i'strict No. 246 as 8:00
o'clock P.M. on November 1, 1965, at the City Hall, Kent,
Washington; and
WHEREAS, notice of said hearing was duly and regularly
given by publication in the Kent -News Journal as provided by law,
and by mailing a notice thereof to the owner or reputed owner of
each lot, tract, parcel of land or other property whose name
appears on such assessment roll, at the address of such owner as
shown on the tax rolls of the County Treasurer for the property
described on the roll; and
WHEREAS, at the time and place of said hearing the
Council met and considered said assessment roll and the written
and oral protests filed ander mad thereto, and said hearing being
continued to November 15, 1965,Aand, after consideration of such/

NOW, THEREFORE, be it ordained by the City Council of
the City.of Kent, Washington, as follows:
Section 1. That the assessments and assessment roll of
Local Improvement District No. 246, for the improvement of certai

streets and avenues in the City by the construction and installa-
tion of water mains, along with gate valves, fittings and other
necessary appurtenances, and doing all necessary work in connecti
(therewith and incidental thereto, as authorized and ordered by
Ordinance No. 1259, passed and approved on the 3rd day of August,
X1964, as such assessments now stand upon such assessment roll, be
land the same are hereby in all things approved and confirmed.
Section 2. That each of the lots, tracts, parcels of
land and other properties shown upon said roll is hereby declared
to be specially benefitted by said improvement in at least the
amount charged against the same, and the assessment appearing
against each such lot, tract, parcel of land and other property
is in proportion to the several assessments appearing upon said
roll. There is hereby levied and assessed against each such lot,
tract, parcel of land and other property appearing upon said roll
the amount finally charged against the same thereon.
Section 3. That the assessment roll as approved and
confirmed shall be filed with the Treasurer of the City of Kent,
Washington, for collection, and that said City Treasurer is hereby
authorized and directed to publish notice as required by law
stating that said roll is in his hands for collection, and that
payments of any assessments thereon or any portion of said assess-
ments can be made at any time within thirty days from the date of
the first publication of said notice without penalty, interest or
cost, and that thereafter the sum remaining unpaid may be paid in
ten equal, annual installments with interest thereon hereby fixed
at the rate of g per cent per annum. The first installment
of assessments on said assessment roll shall become due and payabl
during the thirty day period succeeding the date one year after
the date of first publication by the City Treasurer of notice
that the assessment roll is in his hands for collection and

annually thereafter each succeeding installment shall become due
and payable in like manner. If the whole or any portion of the
assessment remains unpaid after the first thirty day period,
interest upon the whole unpaid sum shall be charged at the rate
of s per cent per annum, and each year thereafter one of said
installments together with interest due on the whole of the un-
paid balance shall be collected. Any installment not paid prior
to the expiration of the said thirty day period during which such
installment is due and payable shall thereupon become delinquent.
All delinquent installments shall be subject to a charge for
interest at ,S7' per cent per annum and for an additional charge
of ,S per cent penalty levied upon both principal and interest
due upon such installment or installments. The collection of such
delinquent installments will be enforced in the manner provided
by .
Section 4. All of such assessments or installments
thereof and interest and penalty, if any, thereon, collected by
the City Treasurer shall be paid into the "Local Improvement
District No. 246 Fund" created by said Ordinance No. 1259 and
shall be used solely for the purpose of paying the principal of
and interest on the warrants and bonds drawn upon or issued
against said fund.
Section S. This Ordinance is declared to be one neces-
sary for the immediate preservation of the public peace, property,
health and safety of the people of the City of Kent, Washington.
An emergency is hereby declared to exist and this Ordinance is
hereby declared to be in full force and effect from and after its
passage, approval and publication as provided by law.
