y AN ORDINANCE of the City of Kent, Washington,
relating to parks and recreational facilities,
creating an Advisory Board of Park Commissioners,
defining their powers and duties, requiring a bud-
get and repealing Ordinances No. 1.6.04 through
1.6.16 of the Kent City Code (0.258 sl through
s5 -- 1911) and all other Ordinances in conflict
therewith.
THE CITY COUNCIL OF THE CITY OF KENT DO ORDAIN AS FOLLOWS:
Section 1. The following Ordinances of the City of
Kent:
111.6.04 BOARD OF PARK COMMISSIONERS CREATED. Upon the
taking effect of this Ordinance and thereafter on the second
Monday in January of each year the Mayor shall appoint a
Board of Park Commissioners consisting of three citizens of
the City who shall serve during the pleasure of the Mayor
and without compensation. 0.258 sl -- 1911)"
"1.6.08 DUTIES OF PARK BOARD. Such Board shall have
charge and control of the parks and parkways of the City
and shall have power to lay out, survey, plat, improve and
beautify the same and make any and all rules and regulations
for the government and management of such parks and parkways
and the use and occupation thereof by the public and by any
and all persons whomsoever. It shall have power to nego-
tiate with the owners of any lands that it may deem desir-
able for park purposes, looking to the purchase of the same
by the City and to recommend to the City Council the pur-
chase of suitable lands for park purposes.
"It shall also have the power to receive and accept
donations of land, property or funds from any source for
the purpose of providing, establishing and maintaining parks
and parkways for the City, but shall place all funds received
or realized from lands and property donated, or from any other
source, in the Treasury of the City to the credit of the Park
Fund, which saall be disbursed only upon warrants properly
drawn against the said Fund, which disbursements shall be
authorized by the City Council upon the recommendation of
the said Board of Park Commissioners. (0.258 s2 -- 1911)."
111.6.12 CARE OF PARKS. The'isaid Park Board shall have
the power of employing such workmen and landscape gardners
and engineers as shall be necessary in caring for, developing
and maintaining parks and parkways consistent with the funds
which shall be available for the payment for such services.

111.6.16 SECRETARY OF PARK BOARD. The City Clerk shall
be the Secretary of the Board of Park Commissioners and all
records of the said Board shall be kept in his office.

are hereby repealed in their entirety.
Section 2. Definition. Words used shall have the
following meaning: "Park" means an area of land with or without
water, developed and used for public recreational purposes, in-
cluding landscape tracts, picnic grounds, playgrounds, athletic
fields, vehicle drives, wild -life sanctuaries, museums, zeologic-
al and botanical gardens, facilities for bathing, boating, huntin
and fishing, as well as other recreational facilities for the use
and benefit of the public. "Board" means Board of Park Commis -
stoners.
Section 3. Creation of Board of Park Commissioners
and Eligibility. There is hereby created a Board of Park Com-
missioners consisting of three members who shall be appointed by
the Mayor, with the consent of the City Council, from citizens
of recognized fitness for such position. No Commissioner shall
receive any compensation for his service.
Section 4. Terms of Commissioners: Filling Vacancies.
The first Commissioners appointed shall determine by lot whose
term shall expire in one, two and three years, respectively, and
their terms shall begin after their appointment has been approved
by the City Council, and upon taking the usual oath of qualifica-
tion. The terms of office, except the first, shallbegin on the
first Monday of June, and at the expiration of each Commissioner'
Term, the Mayor shall appoint, with the consent of the City Coun-
cil, one member for a three year term. Members of the Board may
be removed at any time by the Mayor, and vacancies for the re-
mainder of unexpired terms shall be filled in the same manner in
which original appointments were made.

Section 5. officers of Board; Meetings; Quorum.
Immediately after their appointment, members af the Board shall
meet and organize by electing from the members of the Board a
President, a Secretary, and such other officers as may be nec-
essary. It shall be the duty of the President to preside at all
meetings of the Board, and of the Secretary to keep minutes of
all meetings and of all proceedings of the Board. A majority of
the Board shall constitute a Quorum for the transaction of busi-
ness and two affirmative votes shall be necessary to carry any
proposition. A meeting of the Board shall be held at least once
each month.
Section 6. Powers and Duties of Board. The Board shall
advise the Mayor, the City Council and Department, if any, or
officials administering parks, regarding the general supervision
and control of all parks and recreational facilities and programs
of the City. The Board shall have the power to advise regarding
the establishment of a park and/or recreation department herein-
after called "the department" and regarding the employment of
necessary personnel and to advise regarding the conduct of any
form of recreation or cultural activity that will employ the
leisure time of the people in a constructive and wholesome manner,
and shall advise regarding control and supervision of all parks
belonging to the City, and advise regarding planning, promotion,
management and acquisition, construction, development, maintenance
and operation, including restrictions on and compensation to be
paid for concessions or privileges in parks and/or playgrounds,
either within or without the city limits, of park squares, park-
ways and boulevards, play and recreation grounds, and/or other
municipally owned recreational facilities, including community
buildings and improvement and ornamentation of the same; make
recommendations regarding entering into written contracts with

United States, the State of Washington, any town, city or town pa
District, school District, or any other public organizations for
the purpose of conducting a recreational program or exercising any
other power granted by this Ordinance.
The Board shall submit to the City Council each year,
on or before the second Monday in August, an estimate of the
amount of money required by the Department to carry on its activ-
ities for the ensuing year, together with recommendations for the
development of the program and facilities as it may deem advisable
for the information and guidance of the City Council in preparing
the budget for the tax levy for the operation and maintenance of
the city parks and the recreational program and necessary facil-
ities and the acquisition of lands, structures or facilities
needed therefor. The Board shall have power to recommend rules
and regulations for the government, management, supervision and
control of the city parks and recreational facilities and programs.
Section 7. This Ordinance shall be in full force and
effect from and after its passage, approval and publication as
provided by law,
