ORDINANCE NO. 1304
AN ORDINANCE of the City of Kent, Washington,
providing for the condemnation of an interest
in certain real property.necessary to be ac-
quired for the purpose of establishing easements
for municipal sanitary sewer projects and pro-
viding for the payment for said interests.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That the City Attorney for the City of Kent
be and he is hereby authorized and directed to purchase and/or
institute and prosecute to determination in the Superior Court
of the State of Washington in the County of King an action in the
name of the City of Kent for the condemnation and acquisition of
an easement over, across and under that certain real property lo-
cated in the County of King, State of Washington, and which is
more fully described on Exhibit "A" which is attached hereto and
the terms of which are incorporated herein by reference, for the
purpose of obtaining easements over, across and under said real
property for a municipal sanitary sewer project located in the
City of Kent, Washington.
Section 2. That the acquiring of said lands for the
purpose herein mentioned is for a public use and necessity.
Section 3. The payment for the property herein describ
to be acquired shall be made by interest bearing warrants to be
redeemed as part of the sewer construction costs.
Section 4. Nothing in this Ordinance shall be construe
as a waiver by the City of Kent of its right to decline to take
and pay for said property after the amount of damages has been
ascertained and within the time allowed by law.
Section 5. This Ordinance shall take effect and be
in force from and after its passage, approval and publication as
provided by law.

ORDINANCE 1304
1. Lots 22, 23, 24, 25, 26, 27 and 28, Block 23, Washington Central Improve
ment Company's Knob Hill Addition to Kent, Washington, according to Plat
recorded in Volume 5 of Plats, Page 97, in King County, Washington:

TOGETHER WITH the East Half of vacated Kennebeck Street adjoining; and
TOGETHER WITH the South Half of vacated Chicago Steet adjoining.
This easement consists of those portions of the above described property
included within the limits of a strip of land 20 feet in width and having 10 feet
of such width on each side of the following described centerline:
Beginning at a point on the centerline of vacated Kennebeck Ave. said point
being 10 feet South of the Easterly extension of Morton Street in the City of
Kent, Washington; thence Easterly along a line 10 feet South of and parallel to
the Easterly extension of Morton Street a distance of 5 feet to a point herein-
after referred to as Point "A";
And thence Northeasterly to a point 10 feet Easterly of the centerline of
vacated Kirkwood Ave. and 5 feet Northerly of the centerline of vacated Chicagd
Street.
ALSO beginning at aforementioned Point "A"; thence Southerly along a line
5 feet East of and parallel to the centerline of vacated Kennebeck Avenue to its
intersection with the Westerly extension of the South line of Lot 22, Block 23
of said Washington Central Improvement Cols. Knob Hill Addition to Kent.
TOGETHER WITH a 30 foot temporary construction easement the centerline
of which is the same as that described above.
Said temporary construction easement shall remain in force during con-
struction and until such time as the sewers and appurtenances have been accept
ed for maintenance and operation by the City of Kent.
