ORDINANCE NO.
An Ordinance of the City of Kent approving and
confirming the assessments and assessment roll
1 of L.I.D. No. 245, for the improvement of certain
streets and avenues within the City, by the construc-
t tion and installation of water mains along with
gate valves, fittings and other necessary appurtenances,
3 and by doing all other work necessary in connection
therewith and incidental thereto; levying and assess -

4 ing the amount thereof against the several lots,
tracts, parcels of land and other property as shown
5 on said assessment roll; providing for the payment
of said assessments into Local Improvement District
6 No. 245, Fund, created by Ordinance Nos. 1254 and
1255 of the City; and declaring an emergency.
7 WHEREAS, by motion duly made, seconded and passed, the City
8 Council fixed the date, time and place of the hearing on the
9 assessment roll for Local Improvement District No. 245 as 8:00
10 o'clock P.M. on April 5, 1965, at the City Hall, Kent, Washington;
11 and
12 WHEREAS, notice of said hearing was duly and regularly given
13 by publication in the Kent -News Journal as provided by law, and
14 by mailing a notice thereof to the owner or reputed owner of each
15 lot, tract, parcel of land or other property whose name appears on
16 such assessment roll, at the address of such owner as shown on the
17 tax rolls of the County Treasurer for the property described on
18 the roll; and

WHEREAS, at the time and place of said hearing the Council met
20
''and considered said assessment roll and the written and oral pro -
21
'tests filed and made thereto and, after consideration of such roll
22
!and discussion of such protests, denied all protests and then
23
.ordered the said assessment roll to be confirmed in the manner
24
,required by law.

NO, therefore, be it ordained by the City Council of the City
26
of Kent, Washington, as follows:

Section 1. That the assessments and assessment roll of Logal
28
Improvement District No. 245, for the improvement of certain streets
29
!and avenues in the City by the construction and installation of
30
'water mains, along with gate valves, fittings and other necessary
31
;appurtenances, and doing all necessary work in connection therewith
32

and incidental thereto, as authorized and ordered by Ordinance
1 Nos. 1254 and 1255, passed and approved on the 7th day of July
2 1964, and on the 21st day of July 1964, respectively as such
3 assessments now stand upon such assessment roll, be and the
4 same are hereby in all things approved and confirmed.
5 Section 2. That each of the lots, tracts, parcels of land
6 and other properties shown upon said roll is hereby declared to be
7 specially benefitted by said improvement in at least the amount
8 charged against the same, and the assessment appearing against
9 each such lot, tract, parcel of land and other property is in
10 proportion to the several assessments appearing upon said roll.
11 There is hereby levied and assessed against each such lot, tract,
12 parcel of land and other property appearing upon said roll the
13 amount finally charged against the same thereon.
14 Section 3. The amount of each assessment or any portion thereof
15 may be paid at any time within thirty (30) days from the date of
16 the first publication of the City Treasurer's notice that the
17 'assessment roll has been placed in his hands for collection, without
18 -penalty, interest or costs, and thereafter the sum remaining unpaid,,
19 -if any, may be paid in ten (10) equal annual installments with
20 'interest on the whole unpaid sum at the rate of 5% per annum,
21 ;;such installments coming due each year, commencing with the year
22 1966 on the date that is 30 days after the first publication of
23 said notice and each year thereafter one of said installments,
24 together with the interest due, shall be collected as provided
25 by law and the ordinances of the City of Kent.
26 Section 4. All of such assessments or installments thereof and
27 interest and penalty, if any, thereon, collected by the City
28 Treasurer shall be paid in to the "Local Improvement District No.
29 245 Fund: created by said Ordinance Nos. 1254 and 1255 and shall
30 be used solely for the purpose of paying the principal of and
31 interest on the warrants and bonds drawn upon or issued against

said fund.
,flection 5. This ordinance is declared to be one nec3ssary for
the immediate preservation of the public peace, property, health
1 and safetyof the
people of the City of Kent, Washington. An

emergency is hereby declared to exist and this ordinance is hereby
3 declared to be in full force and effect from and after its passage,
4 approval and
pp publication as provided by law.
5 PASSED by the Council of the City of Kent, Washington, and
6
approved by the Mayor at a regular meeting of said Council held
7
this 5th day of April, 1965.
