HomeMy WebLinkAbout1280Pi 7 8 9 10 11 12 13 14 15 16 171 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE N0. 12 " A14 ORDINANCE of the City of Kent, Washington, adopting by reference certain Statutes of the State of Washington, to establish a Civil Ser- vice system and regulations for firemen of the City of Kent, in anticipation of the date when the City of Kent shall establish a "full paid" Fire Department as defined by the State of Washington. WHEREAS, the City of Kent, Washington, presently has a volunteer, non -full paid fire department which is not subject to the laws of the State of Washington requiring civil service rules and regulations for firemen, and WHEREAS, the City of Kent has budgeted and planned Ifor the establishment of a full paid fire department as of August 1, 1965, and WHEREAS, once the City of Kent establishes a full paid fire department it will be required to implement and establish a civil service department for same, with rules and regulations as required by the laws of the State of Washington, and WHEREAS, in order to facilitate the establishment of a full paid fire department for the City of Kent, the City Council of the City of Kent deems it in the best interests of the health and welfare of the citizens of the City of Kent to enact ordinance establishing a fire department civil service commission, with rules and regulations pertaining thereto, all as required by the laws of the State of Washington, NOW, THEREFORE, THE CITY COU14CIL OF THE CITY OF KENT do ordain as follows: Section 1. The following Statutes of the State of Washington, together with all amendments and additions to said Statutes, when printed and three copies thereof filed with the City Clerk of the City of Kent, are hereby adopted by reference: RCW 41.08.030 (Civil Service Commission created - Appointment - Terms - Removal - Quorum.) In enacting this Ordinance, it is antici- pated that the City of Kent will have established a "full paid" fire department (as defined in R.C.W. 41.08.220 of the Laws of the State of Washington) by August 1, 1965, and it is hereby declared to be the legislative intent in enacting this Ordinance that the provisions of this Ordinance shall be enforced to assist in the establishment of a fire department civil service commission with rules and regulations pertaining thereto, prior to the time the City of Kent establishes a "full paid" fire department; PROVIDED, HOWEVER, that the ordinances, rules and regulations of the City of Kent which are in force upon the effective date of this Ordinance and which pertain to the City's present volunteer, non -full paid fire department and personnel shall continue to remain in full force and effect until such time as the City actually establishes a "full paid" fire department. Section 3. SEVERABILITY. If any section, subsection, subdivision, sentence, clause or phrase of this Ordinance shall -2- 1 2 3 4 5 6 7I 81 for any reason, be held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. Section k. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as by law provided.
