AN ORDINANCE of the City of Kent providing
for the condemnation of certain property
rights to be acquired for the purpose of
expanding the sewerage system of the City
of Kent and providing for the payment of
said land.
The City Council of the City of Kent do ordain as
follows:
Section 1: That the Citv attorney for the City of
Kent, be and he is hereby authorized and directed to purchase
and or institute and prosecute to determination in the Superior
Court of the State of Washington, in the County of. King, an
action in the name of the City of Kent for the condemnation
and acquisition of the leasehold property interests pertaining
to the following described land situated in the County of King,
State of Washington, for the purpose of expanding the sewerage
system of the City of Kent:
The west half of the SE 1/4 of Section
11, Township 229 North, Range 4 EWM, less
right-of-way for drainage ditch; and less
that portion thereof lying southerly of a
line running from a point on the east line
of said sub -division 500 feet north of the
southeast corner thereof to a point of the
west line thereof 280 feet north of the
southwest corner thereof.
Section 2. That the acquiring of said leasehold property
interests pertaining to said described real property for the
purpose herein mentioned is for a public use and necessity.
Section 3. The payment for the property herein des-
cribed to be acquired shall be made from the SiWAA fund of the
City of Kent.
Section 4. Nothing in this Ordinance shall be construed
as a waiver by the City of Kent of its right to decline to take
and pay for said property after the amount of damages has
been ascertained and within the time allowed by law.
Section S. This Ordinance shall take effect and
be in force five (5) days after its passage, approval, and
publication, as provided by law.
