AN ORDINANCE of the CITY OF KENT providing for
the condemnation of certain land necessary to
be acquired for the purpose of extending Wiiwer �_"
Street and providing for the payment for said
land
THE CITY COUNCIL OF THE CITY OF KENT DO ORDAIN AS
FOLLOWS:
Section 1: That the City Attorney fie the City of
Kent, be and he is hereby authorized and directed to pur-
chase and/or institute and prosecute to determination in
the Superior Court of the State of Washington, in the
County of King, an action in the name of the City of Kent
for the condemnation and acquisition of the following des-
cribed land, situated in the County of King, State of
Washington, for the extension and widening of Wirer—
Street, in the City of Kent, to -wit: U
Portion of SW 1/4 of Section 13, Township 22
North, Range 4 East, W. M.
Beginning at the intersection of the center-
line of C. M. St. P. 8 P. Ry. Co's main line
and the South line of the SW 1/4 of Sec. 13,
Township 22 North, Range 4 East, said point
being 728 feet, more or less, West of the South-
east corner of said SW 1/4, and run thence
S 88°24148" E. along said South line, 43 feet;
thence N 00059112" E, along the East line of
C.M., St. P., 8 P. Ry. Co's right"'Y'of-way, 33
feet; thence N 88024148"W, 100 feet; thence
S00059112"W9 33 feet; thence S 88124148" E, 57
feet to the point of beginning.
and
Portion of the NW 1/4 of Section 24, Township 22
North, Range 4 East,, W.M.
Beginning at the intersection of the center-
line of the C.,M., St. P. 8 P. Ry Co's main
line and the North line of the NW 1/4, Section
24, Township 22 North, Range 4 East, said point
being 728 feet, more or less, West of the NE cor-
ner of said NW 1/4 and run thence N 88024148" W.
57.6 feet to the West line of the C.M., St. P 8
P. Ry Co!s right-of-way through the NW 1/4 of
said Section 24; thence S 00059'12" W, along
said West line, 33 feet; thence S 88024'48" E,
123.5 feet; thence N 00059'12" E, 33 feet to the
North line of said NW 1/4; thence N 88024148" W,
65.9 feet to the point of beginning.

Section 2: That the acquiring of said land..for the
purpose herein mentioned, is for a public use and necessity.
Section 3: That payment for the property herein des-
cribed to be acquired, shall be made from the current ex-
pense fund of the City of Kent.
Section 4: Nothing in this Ordinance. shall be
construed as a waiver by the City of Kent of its right
to decline to take and pay for said property after the
amount of damages has been ascertained and within the time
allowed by law.
Section 5: This Ordinance shall take effect and
be in force five (5) days after its passage, approval and
publication, as provided by law.
