ORDINANCE NO.
An Ordinance of the City of Kent approving and
confirming the assessments and assessment roll
of L.I.D.No. 244, for the improvement of certain
streett and avenues within the City, by the construc-
tion and installation of a 12 inch water main along
with gate valves, fittings and other necessary
appurtenances, and by doing all other work necessary
in connection therewith and incidental thereto;
levying and assessing the amount thereof against
the several lots, tracts, parcels of land and other
property as shown on said assessment roll; providing
for the payment of said assessments into Local Improve-
ment District No. 2244 Fund, created by Ordinance No.
1121A of the City; and declaring an emergency
WHEREAS, by motion duly made, seconded and passed, the City
Council fixed the date, time and place of the hearing on the
assessment roll for Local Improvement District No. 244 as 8:00
o'clock P.M. on October 15, 1962, at the City Hall, Kent, Wash -
irk on; and
WHEREAS, notice of said hearing was duly and regularly given
by publication in the Kent -News Journal as provided by law, and
by mailing a notice thereof to the owner or reputed owner of each
lot, tract, parcel of land or other property whose name appears on
such assessment roll, at the address`>>of such owner as shown on the
tax rolls of the County Treasurer for.1the property described on
the roll; and
WHEREAS, at the time and place of said hearing the Council met
and considered said assessment roll and the written and oral pro-
tests filed and made thereto and, after consideration of such roll
and discussion of such protests, denied all protests and then
ordered the said assessment roll to be confirmed in the manner
required by law.
NOW, therefore, be it ordained by the City Council of the City
f Kent, Washington, as follows:
28 Section 1. That the assessments and assessment roll of Local
29 Improvement District No. 244, for the improvement of certain street
30 nd avenues in the City by the construction and installation of a
31 2 inch water main, along with gate valves, fittings and other
ecessary appurtenances, and by doing all necessary work in

connection therewith and incidental thereto, as authorized and
ordered by Ordinance No. 1121A, passed and approved on the 5th day
of March, 1962, as such assessments now stand upon such assessment
roll, be and the same are hereby in all things approved and confinaed.
Section 2. That each of the lots, tracts, parcels of land and
other properties shown upon said roll is hereby declared to be
specially benefitted by said improvement in at least the amount
charged against the same, and the assessment appearing against
each such lot, tract, parcel of land and other property is in
proportion to the several assessments appearing upon said roll.
There is hereby levied and assessed against each such lot, tract,
parcel of land and other property appearing upon said roll the
amount finally charged against the same thereon.
Section 3. The amount of each assessment or any portion thereof
may be paid at any time within thirty (30) days from the date of
the first publication of the City Treasurer's notice that the
assessment roll has been placed in his hands for collection, witho t
penalty, interest or costs, and thereafter the sum remaining unpaid
if any, may be paid in five (5) equal annual installments with
interest on the whole unpaid sum at the rate of 5% per annum,
such installments coming due each year, commencing with the year
1963 on the date that is 30 days after the first publication of
said notice and each year thereafter one of said installments,
11together with the interest due thereon and on all installments
11thereafter to become due, shall be collected as provided by law
and the ordinances of the City of Kent.
Section 4. All of such assessments or installments thereof and
interest and penalty, if any, thereon, collected by the City
Treasurer shall be paid in to the "Local Improvement District No.
244 Fund) created by said Ordinance No. 1121A, and shall be used
solely for the purpose of paying the principal of and interest on
the warrants and bonds drawn upon or issued against said fund.

Section 5. This ordinance is declared to be one necessary for
the immediate preservation of the public peace, property, health
and safety of the people of the City of Kent, Washington. An
emergency is hereby declared to exist and this ordinance is hereby
declared to be in full force and effect from and after its passage,
approval and publication as provided by law.
PASSED by the Council of the City of Kent, Washingon, and
approved by the Mayor at a regular meeting of said Council held
this 5th day of November, 1962.
