ORDINANCE NO. 0--5`9'
An Ordinance of the City of Kent, approving and
confirming the assessments and assessment roll of
L.I.D. No. 243, for the improvement of certain
streets, alleys and easements within the City of
Kent by the construction and installation of an
18 inch sanitary sewer trunk line, with manholes,
a siphon, and other necessary appurtenances, to-
gether with all necessary work in connection there-
with and incidental thereto; levying and assessing
the amount thereof against the several lots, t&acts,
parcels of land and other property as shown on said
assessment roll; providing for the payment of said
assessments into the Enlarged Local Improvement
District No. 243 Fund, created by Ordinance No. 1101
of the City; and declaring an emergency.
WHEREAS, by motion duly made, seconded and passed, the City
Council of the City of Kent fixed the dEte, time and place of the
hearing on the assessment roll for Enlarged Local Improvement
District No. 243 as 8:00 o'clock P.M. on the 1st day of October,
1962, at the City Hall, Kent, Washington; and
WHEpYAS, noticecf said hearing was duly and regularly given
by publication in the Kent -News Journal as provided by law, and
by mailing a notice thereof to the owner or reputed owners of each
1lot, tract, parcel of land or other property whose name appears
Ion such assessment roll at the address of such owner as shown
Ion the tax rolls of the County Treasurer for the property described

WHEREAS, at the time and place of said hearing the Council met
Band considered said assessment roll and the written and oral pro-
11tests filed and made thereto; and thereafter continued the said
aring until the 15th day of October, 1962, at which time the
cil again met to consider the said assessment roll; and
fter consideration of said roll and a discussion of protests and
bjections thereto, denied all protests and then ordered the said
ssessment roll to be confirmed in the manner required by law.
Now, therefore, be it ordained by the City Council of the City
f Kent, Washington, as follows:
Section 1. That the assessments and assessment roll of Enlarged

Local Improvement District No. 243, for the improvement of certain)
streets, alleys and easements within the City by the construction
and installation of an 18 inch sanitary sewer trunk line, with
manholes, a siphon and other necessary appurtenances, and by doing
all work necessary in connection therewith and incidental thereto,
as authorized and ordered by Ordinance No. 1101, passed and app
on the 7th day of August, 1961, as such assessments now stand upon
such assessment roll, be and the same are hereby in all things
approved and confirmed.
Section 2. That each of the lots, tracts, parcels of land
and other property shown upon said roll is hereby declared to be
specially benefitted by said improvement in at least the amount
charged against the same, and the assessment appearing against
each such lot, tract, parcel of land and other property is in
proportion to the several assessments appearing upon said roll.
There is hereby levied and assessed against each said lot, tract,
parcel of land and other property appearing upon said roll the
amount finally charged against the same thereon.
Section 3. The amount of each assessment or any portion thereof
may be paid at any time within thirty (30) days from the date of
the first publication of the City Treasurer's notice that the
assessment roll has been placed in his hands for collection, withou
penalty, interest or costs, and thereafter the sum remaining unpaid
if any, may be paid in eight (8) equal annual installments with
interest on the whole unpaid sum at the rate of 5% per annum, such
installments coming due each year, commencing with the year 1963,
n the date that is 30 days after the first publication of said
otice and each year thereafter, one of said installments, together
ith interest due thereon and on all installments thereafter to
ecome due, shall be collected as provided by law and the ordinance:

Section 4. All of such assessments or installments thereof and
nterest and penalty, if any, thereon, collected the City Treasurer

shall be paid in the "Enlarged Local Improvement District No. 243
Fund" created by said Ordinance No. 1101, and shall be used solely
for the purpose of paying the principal of and interest on the
warrants and bonds drawn upon or issued against said fund.
Section 5. This ordinance is declared to be one necessary for
the immediate preservation of the public peace, property, health
and safety of the people of the City of Kent. An emergency is
hereby declared to exist and this ordinance is hereby declared
to be in full force and effect from and after its passage, approva
and publication, as provided by law.
PASSED by the Council of the City of Kent, Washirgon, and
approved by the Mayor at a regular meeting of said Council held
this 5th day of November, 1962.
