ORDINANCE No. //;39,
An Ordinance of the City of Kent declaring
an emergency, making an appropriation and
providing for the issuance of warrants,
for capital outlay of the water fund and for
the expense of the sewer fund.
WHEREAS, the City of Kent in its budget for expense of the
sewer fund for the year 1962, made no appropriation for ,judgments,
or payment of damages occasioned in the operation of the sewer
system of the City of Kent; and
WHEREAS, in a pending action in the Superior Court of the State
of Washington, entitled "Narita vs. the City of Kent", in
which the plaintiff claimed damages for injury to crops and
land allegedly caused by improper operation and maintenance of
a City sewer, a settlement has been reached between the plaintiff
and the City, providing for the payment by the City of the sum of
Three -thousand ($3,000.00)Dollars; and
WHEREAS, in order to meet the requirements of the settlement
in said action it is necessary to appropriate funds for sewer
fund expense; and
WHEREAS, the City of Kent in its budget for capital outlay of
the water fund made no appropriation for the acquisition of cer-
tain land containing a spring and creek which is a tributary of
the Qreen River, and which is known as "Icy Creek", and which
land is to be purchased by the City of Kent; and
WHEREAS, it has become necessary to appropriate funds for the
acquisition of said Icy Creek land; now, therefore,
THE CITY COUNCIL OF THE CITY OF KENT DO ORDAIN as follows:
Section 1. That emergencies exist as set forth in the preamble
of this ordinance that could not reasonably have been foreseen
at the time of the making of the budget for the year 1962.
Section 2. That it is necessary to sustain the proper operation
of sewer fund of the City of Kent that an emergency appropriation
be made for expense of the sewer fund; and that it is necessary
to sustain the proper operation and maintenance of the water fund

of the city of Kent that an emergency appropriation be made for
capital outlay of the water fund; that the estimated amounts
necessary to meet said emergencies are as follows:
For the expMhsi� fund of the sewer fund of the City $3,000-00
For the capital outlay of the water fund of the City $26,500.00.
Section 3. That there is hereby appropriated for the sewer fund
expense, the sum of $3,000.00; that there is hereby appropriated
for capital outlay of the water fund of the City the sum of
$26,500.00; that if necessary emergency warrantp shall be issued
for said amounts, or for such portions thereof as shall be needed,
such emergency warrants to bear interest at the rate of six (6)
per cent per annum from the date of issue until pid.
Section 4. That the amounts drawn against said sewer fund
expense, and against the wtter fund capital outlay, by said
emergency warrants, if any, shall be included in the tax levy
for the year 1963, as by law provided.
Section 5. That this ordinance shall be in force five (5)
days after its passage, approval and publication as provided by
law.
