An ordinance of the City of Kent, Washington,
providing for the improvement of certain
streets and avenues in the City by the
construction and installation of a 12 inch
water main, along with bate valves, (fire
hydrants, if possible), fittings and other
necessary appurtenances, and by doing all
other work necessary in connection therewith
and incidental thereto, pursuant to Resolution
No. 466 of the City; creating a Local Improve-
ment District therefor, and providing that
payment of part of the cost of said improve-
ments be made by special assessment upon the
property in said district, payable by the mode
of payment by bonds, and that the rest of such
cost ue borne by the City.

WHEREAS, on the 1jth day of January, 1962, the Council of the
City of Kent, Washington, adopted its Resolution No. 466,
declaring its intention to order the improvement of certain
streets and avenues within the City, by the construction and
installation of a 12 inch water main, with appurtenances, and
by doing all other work necessary in connection 'therewith and
incidental thereto, which resolution fixed the time, date and
place of hearing thereon at 8:00 o'clock P.M. on the 19th day
of February, 1962, at the City Hall,.Kent, Washington; and
WHEREAS, such resolution was duly published in the manner
required by law and the notice of said hearing was duly given
to the owners or reputed owners of all lots, tracts and parcels
of land or other property to be specially benefitted by the
proposed improvement, as required by law, and
WHEREAS, said hearing was held on said date and at said time
and place, as provided in said resolution and notice, and after
a discussion of said improvements, and after hearing all protests
and discussions of the same, the Council then ordered the improve-
ments described in said Resolution No. 400" to be constructed and
installed, except that the fire hydrants provided in said resolu-
tion should be installed only if the bid price is within the
limits allowed by law; and
WHEREAS, said Council also determined that the City should
contribute the amount of $10,13,3.12 to the cost of such improve-
ments;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of

Kent, Washington, as follows:
Section 1. The following described streets and avenues
within the City shall be improved by the construction and
installation of the following described improvements, to -wit:
12 inch water main alonL,- with gate valves, fire hydrants if
within the limits allowed by law, fittings and other
necessary appurtenances along the Lake Fenwick Road from
the Reith Road to the south line of the northeast quarter
of the northeast quarter of Section 22, Township 22 north,
Range 4 East, d.m., in Kent, King County, Washington,

to -ether with all necessary appurtenances thereto, and by doing

all other work necessary in connection there -with and incidental
thereto, all in accordance with maps, pl3ns and specifications
prepared by the City Engineer, which maps, plans and specifica-
tions are hereby adopted as those necessary and required for
these improvements.
Section 2. That there be and is hereby established a Local
Improvement District of the City if Kent to be known as "Local
Improvement District No. 244"• expense of
Approximately $11,'(12.00 of the entire cost and ex
said improvements and appurtenances, includin-, all necessary
expenses incidental thereto, shall be borne by and assessed
against the property included in the Local Improvement District
heretofore ore created. The City of Kent shall bear approximately

$10,136.12 of the cost of such improvements, appurtenances and
incidental expenses.
The Improvment District shall include all the property containEd
within the following boundary lines, to -wit:
Beginning at a point 1141.3:!) feet north and 83.19 feet
West of the southeast corner of the southeast quarter,
Sec. 22, Township 22 North, Range 4 East W.M., and run thence
southeasterly to a point lo8c'.64 feet north and 82(-34 feet

west of said southeast corner of the southeast quarter of
section 22, said point beinL,, in the east line of the O.H.
Benson Road (Lake Fenwick Road) and the True Point of Be-

parallel to the northline of the southeast quarter of the
southeast quarter of said Section 22 to a point which is
13D feet northeasterly at right an. -les to the east line of
the O.H.Benson Road (Lake Fenwick Road); thence southerly,
parallel to the east line of the O.H. Benson Road (Lake Fenwic�
Road) to the south line of the northeast quarter of the
northeast quarter of Section 2(, Township 22 North, Range 4
E.W.M.; thence north 8�0,OV48" west, along said south line of

parallel to the west line of the Q. H. Benson Road (Lake
Fenwick Road) to a point in a line drawn 135 feet southeasterly
at right angles and parallel to the southeasterly line of the
J. L. Reith Road; thence northeasterly, along said parallel lina,
to a point drawn y0 feet southwesterly at right angles to the
west line of the Q.H. Benson Road (Lake Fenwick Road); thence
northerly, parallel to the West line of the Q.H. Benson Road
(Lake Fenwick Road) to the east line of the J. L. Reith Road;
thence northeasterly along the easterly line of the J. L.
Reith Road, to its intersection with the west line of the
0. H. Benson Road(Lake Fenwick Road); thence northeasterly,
to the True Point of Beginning.
Tlut the City Council finds that the nature of the improvement
is such that the special benefits conferred on the property are
not fairly reflected by the termini and zone method,and the
assessments shall be made against the property in the district
in accordance with the special benefits it will derive from the
improvement, without regard to the zone and termini method, and
the assessment shall be computed in a manner which will fairly
reflect the special benefits derived from the improvements.
Section 3. Bonds of said Local Improvement District, bearinb
interest at a rate of not to exceed bh per annum and payable
on or before __years from date of issue, shall be issued
in payment of the cost and expense of the improvements provided
for herein,which bonds shall be redeemed by the collection of
special assessments to be levied and assessed upon the property
within the district as above provided, such assessments to be
payable in equal installments, and with interest at a rate
of not to exceed b per annum under the mode of "payment by
bonds", as defined by law and the ordinances of the City of Kent.
Any assessments or installments thereof when delinquent, and
the interest due thereon, shall bear a penalty of 5 of the
total amount thereof from the date of such ablinquency.
That there be and there is hereby created a fund of the City
to be known as "Local Improvement District No. 244 Fund".
Warrants bearing interest at a rate of not to exceed of per annum
shall be drawn on said fund, based on estimates of the City's
Engineers, in payment of the cost of construction of said im-
provements and all costs incidental thereto.
The money received from the sale of said warrants shall be

placed in the Local Improvement District No. 244 Construction
Fund of the City which is hereby created, and shall be used to
pay all of said costs.
The rate of interest to be borne by said warrants, bonds and
installments of said assessments shall be as hereafter fixed by
the City Council. The bonds of this district to -be issued
shall be delivered to the owner or owners of said Local
Improvement District No. 244 Fund warrants, in redemption of
the same.
Section 4. This ordinance shall become effective five days f
and after its passage, approval and publication, as required
by law.
