An Ordinance of the City of Kent, vjashington, approving and confirming the assessments and assessment roll of L.I.D.No. 241, for the improvement of certain street: and avenues within the City of KeTlt, ; the construction and installation of ornamental standards of mercury vapor street ligYlts, pole mounted mercury vapor street lights, tooetner with all necessary work in connection therewith and incidental thereto; levying and assessing the amount thereof' against the several lots, tracts, parcels of land and other Nroperty as shown on said assessment roll; pro- viding i'or the payment of said assessments into the Local Improvement District No. 241 Fund, created by Ordinance No. I06'(" of the Ci ; and deciarin an emergency. WHEREAS, by motion duly made, seconded and passed on the 16th day of December, 1961, the City Council fixed the date, time and place of the hearing on the assessment roll for Local Improvement District No. 241 as 6:00 o'clock P.M. on February , 1,62, at the City Hall, Kent, Washington; and WHEREAS, notice of said hearing was duly and regularly given by publication in the Kent -News Journal on the 20th and 2'jth days car December, 1961, and by mailing a notice thereof to the owner or reputed owner of each lot, tract, parcel of land or other propert whose name appears on such assessment roll at the address of such owner as shown on the tax rolls of the County Treasurer for the property described on the roll; and WHEREAS, at the time and place of said hearing the Council met and considered said assessment roll and the written and oral pro- tests filed and made thereto and, after consideration of such roll and discussion of such protests, allowed the protest of Nor- thern Pacific Railway Co., and denied all other protests, and then ordered the said assessment roll as corrected to be confirme in the manner required by law. Now, therefore, be it ordained by the City Council of the City of Kent, Washington, as follows: Section 1. That the assessments and assessment roll of Local Improvement District No. 24.1, for the improvement of certain streeps and avenues within the City by the construction and installation of ornamental standards and mercury vapor street lights, and pole mounted mercury vapor street lights, and all necessary appurtenances 1. thereto and by doing all work necessary in connection therewith and incidental thereto, as authorized and ordered by Ordinance No. 1087, passed and approved on the 20th day of February, 1961, as such assessments now stand upon such assessment roll, be and the same are hereby in all things approved and confirmed. Section 2. That each of the lots, tracts, parcels of land and other properties shown upon said roll is hereby declared to be specially benefited by said improvement in at least the amount charged against the same, and the assessment appearing against each such lot, tract, parcel of land and other property is in proportion to the several assessments appearing upon said roll. There is hereby levied and assessed against each such lot, tract, parcel of land and other property appearing upon said roll the amount finally charged against the same thereon. Section 3. The amount of each assessment or any portion thereo may be paid at any time within thirty (30) days from the date of the first publication of the City Treasurer's notice that the assessment roll has been placed in his hands for collection, witho t penalty interest or costs, and thereafter the sum remaining unpaid if any, may be paid in five (5) equal annual installments with interest on the whole unpaid sum at the rate of 5o per annum, such installments coming due each year, commencing with the year 1963 on the date that is 30 days after the first publication of said notice and each year thereafter one of said installments, together with the interest due thereon and on all installments thereafter to become due, shall be collected as provided by law and the ordinances of the City of Kent. Section 4. All of such assessments or installments thereof andl interest and penalty, if any, thereon, collected by the City Treasurer shall be paid into the "Local Improvement District No. 241 Fund" created by said Ordinance No. 1067, and shall be used solely for the purpose of paying the principal of and interest on the warrants and bonds drawn upon or issued against said fund. Section 5. This ordinance is declared to be one necessary for I 2. 1 the immediate preservation of the public peace, property, health and safety of the people of the City of Kent, Waslington. An emergency is hereb declared to exist and this ordinance is hereby declared to be in full force and effect from and after its assage, approval, and publication, as provided by law.
