ORDINANCE No.
An Ordinance of the City of Kent declaring
an emergency, making an appropriation and
providing for the issuance of warrants,
for the capital outlay fund of the Fire
Department of the current expense fund of
the City of Kent and for attorneys' fees
and judgments fund of the current expense
fund of the City of Kent.
WHEREAS, the City of Kent in its budget for current expense,
Fire Department capital outlay, for the year 1961, appropriated
$12 000.00 for the
purchase of a new fire truck for the City, and

WHEREAS, upon the calling for and submission of bids for the
said fire truck it became apparent that the amount so budgeted i
was insufficient to make the purchase of said fire truck; and
WHEREAS, in order to supply the needs of the City in the
purchase of said needed fire truck it has become necessary to
appropriate additional funds for capital outlay of the Fire
Department of the current expense fund of the City; and
WHEREAS, the City of Kent made no appropriation for attorneys'
fees and judgments for the budget for the year 1961, for the
maintenance and operation of the City; and
WHEREAS,; the City is involved in litigation and has incurred
obligations for counsel fees and costs and there is a possibility
of judgments being rendered against the City, for which payment
must be made; and
WHEREAS, it has become necessary to appropriate funds for
counsel fees and judgments for the year 1961; now, therefore,
THE CITY COUNCIL OF THE CITY .OF KENT DO ORDAIN as follows:
Section 1. That emergencies exist as set forth in the preamble
;of this ordinance that could not reasonably have been foreseen at

the time of the making of the budget for the year 1961.
G' Section 2. That it is necessary to sustain the proper opera-
ltion of the Fire Department of the City of Kent that an emergency
!'appropriation be made for capital outlay for the Fire Department
Ein the current expense fund; and that it is necessary to sustain
#'the proper operation and maintenance of the City that emergency
appropriation be made for counsel fees and judgments for the

year 1961; that the estimated amounts necessary to meet said
emergencies are asfollows:
For the capital outlay fund of the Fire Department
of the current expense fund of the City $
For counsel fees and judgments of the current
expense fund of the City $5,000.00.
Section 3. That there is hereby appropriated for capital out -

that there is hereby appropriated for counsel fees and judgments
of the current expense fund of the City, the sum of $5,000.00;

!that if necessary emergency warrants shall be issued for said
!amounts, or for such portions thereof as shall be needed, such
,emergency warrants to bear interest at the rate of six (6) per
!cent per annum from the date of issue until paid.

Section 4. That the amounts drawn against said eapibiluoutlay
'Fire Department, current expense fund, and against said counsel
i�
fees and judgments, current expense fund, by said emergency
Ewarrants, if any, shall be included in the tax levy for the year
11962, as by law provided.
Section 5. That his ordinance shall be in force five (5) days
i1i1after its passage, approval and publication as provided by law.
