ORDINANCE NO. 0-/6
AN ORDINANCE of the City of Kent,
Washington, vacating a portion of 76th Ave-
nue South and South 194th Street, certain
streets within the city limits of the City
of Kent.
WHEREAS proper application was filed with the City of
Kent for the vacation of dedicated public streets of the City of
Kent; and
WHEREAS thereafter, the Kent City Council did, by reso-
lution fix a time when said petition would be heard and determin-
ed by the Kent City Council or a committee thereof, to -wit:
Monday, May 7, 1979 at the hour of 8 o'clock p.m. in the Council
Chambers of the City Hall of the City of Kent, Washington; and
WHEREAS after the passage of said motion, the City Clerk
of the City of Kent gave twenty (20) days notice of the pendency
of said petition by a written notice posted in three (3) of the
most public places in the City of Kent and a like notice in con-
spicuous places on the streets sought to be vacated; said notice
containing the information required therein by the Laws of the
State of Washington and the ordinance of the City of Kent; and
WHEREAS the Kent Planning Director has processed said
petition and secured the technical facts pertinent to the ques-
tion of said vacations which includes a sketch of the proposed
vacation and also written approval or rejection thereof by the
water, sewer and street departments of the City of Kent; and
WHEREAS the hearing on said petition was held in the
Council Chambers of the City Hall of the City of Kent at 8 o'clock
p.m. on the 7th of May, 1979, and it appearing further that the
granting of said petition for the vacation of said streets will
not be a menace or inconvenience to the traveling public or to
any other persons using the streets and alleys of the City of
Kent, Washington,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The following described streets within the
city limits of Kent, Washington, and which are more fully describ
ed herewith:
That portion of 76th Avenue South abutting
Tract 26, Highway Homes Garden Tracts, un-
recorded and lying northerly of the south
line of said Tract 26 extended easterly.
Also, all of South 194th Street lying south
of the abutting Tracts 1 and 2, Highway
Homes Garden Tracts, unrecorded, in Kent,
King County, Washington.
are hereby vacated, reserving, however, an easement for drainage
and utilities over the entire width of the vacated portion of
76th Avenue South.
Section 2. No vested rights shall be affected by the
provisions of this Ordinance.
Section 3. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication as provided by law.
