AN ORDINANCE of the City of Kent, Washington, providing for the condemnation of certain property and property rights in King County for the purpose of widening and improving 84th Avenue South, a public street in the City of Kent, and providing for pay- ment for said land. THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO l�HEREBY ORDAIN AS FOLLOWS: Section 1. 1 ;Kent be and he is hereby hat the City Attorney for the City of authorized and directed to purchase and ',or institute and prosecute to determination in the Superior Court of the State of Washington, in the County of King, an action in the name of the City of Kent for condemnation and acquisition of 1'tlthe following described property and property rights situated in 1=the County of King, State of Washington, for the purpose of pro- jviding for the widening and improving of 84th Avenue South, a pub- Ilic street in the City of Kent. PARCEL 2 & 3. (Benaroya): Beginning at the northeast corner of Section 12, Township 22 North, Range 4 East, W.M., in King County, Wash- ington, thence West along the north line there- of a distance of 3. 0 00 feet to point oint on the west g e t mar in of 84th Avenue South, thence ce s ou th a along g said margin a distance ce of 121.56 feet to the TRUE POINT OF BEGINNING, thence west paral- lel with said north line a distance of 4.00 feet, thence in a southeasterly direction in a straight line to a point on said west margin which point lies 139.50 feet south of the point of begin- ning, thence north along said west margin a dis- tance of 139.50 feet to the TRUE POINT OF BEGIN- NING. Section 2. That the acquiring of said land for the purpose herein mentioned is for a public use and necessit-. Section 3. Payment for land use herein described to be acquired shall be made from State of Washington Urban Arterial Funds, assessments against the properties specially benefited by the improvement, and from other City of Kent general funds allo- cated for the purpose. Section 4. Nothing in this Ordinance shall be con- strued as a waiver by the City of Kent of its rights to decline to take and to pay for said land after the amount of damages has been ascertained and within the time allowed by law. Section 5.
