ORDINANCE NO.
AN ORDINANCE of the City of Kent, Wash-
ington, vacating a portion of Burke Avenue, a
certain street within the city limits of the
City of Kent.
WHEREAS a proper application was filed by the City of
Kent for the vacation of a dedicated public street of the City of
Kent; and
WHEREAS thereafter, the Kent City Council did, by
resolution fix a time when said petition would be heard and deter-
mined by the Kent City Council or a committee thereof, to -wit:
Monday, February 6, 1978, at the hour of 8 o'clock p.m. in the
Council Chamber of the City Hall of the City of Kent, Washington;
and
WHEREAS after the passage of said motion, the City Clerk
of the City of Kent gave twenty (20) days notice of the pendency
of said petition by a written notice posted in three (3) of the
most public places in the City of Kent and a like notice in con-
spicuous places on the street sought to be vacated; said notice
containing the information required therein by the Laws of the
State of Washington and the ordinances of the City of Kent; and
WHEREAS the Kent Planning Director has processed said
petition and secured the technical facts pertinent to the question
of said vacation which includes a sketch of the proposed vacation
and also written approval or rejection thereof by the water, sewer
and street departments of the City of Kent; and
WHEREAS the hearing on said petition was held in the
Council Chambers of the City Hall of the City of Kent at 8:00
o'clock p.m. on the 6th day of February, 1978, and it appearing
further that the granting of said petition for the vacation of
said street will not be a menace or inconvenience to the traveling
public or to any other persons using the streets and alleys of the
City of Kent, Washington,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. The following described street within the
city limits of Kent, Washington, and which is more fully described
herewith:
That portion of Burke Avenue lying within the
SE quarter of Section 22, Township 22 North,
Range 4 East, W.M., in King County, Washing-
ton, lying northerly of the south line of Lot
8, Block 9, Kent Addition to the City of Kent
as recorded in Volume 2 of Plats, Page 165,
Records of King County, Washington, projected
easterly; and lying southerly of a point which
is 30 feet south of and parallel to the south
line of Lot 14, Block 8, of said Kent Addition
projected easterly.
is hereby vacated, reserving, however, an easement for that portion
of sanitary sewer which lies in what would be the intersection of
Morton Street and Burke Avenue.
Section 2. No vested rights shall be affected by the
provisions of this Ordinance.
Section 3. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication as provided by law.
