AN ORDINANCE of the City of Kent,
Washington, relating to the installation
and maintenance of smoke detectors in oc-
cupancies that are rented, leased or let.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. Smoke detectors shall be installed and
maintained in accordance with the provisions of this Ordinance
in the following occupancies that are rented, leased, or let to
a person or persons:
(a) Group R, Division 1 of the Uniform
Building Code, 1976 Edition, Guest
Rooms and Dwelling Units, i.e.,
hotels, motels, apartments and con-
dominiums.
(b) Group R, Division 3 of the Uniform
Building Code, 1976 Edition, Dwel-
ling Units, i.e., duplexes, single
family dwellings and lodging houses.
(c) Mobile Home Dwelling Units.
Section 2. Any Group R, Division 3, Mobile Home or
condominium occupancy sold following the effective date of this
Ordinance shall have installed therein smoke detectors. Instal-
lation of smoke detectors shall be the responsibility of the
seller.
Section 3. Smoke detectors installed in accordance
with the provisions of this Ordinance shall be of an approved
type conforming to Uniform Building Code Standard 43-6 or of a
type listed by a nationally recognized testing laboratory.
Section 4. The method of installation of smoke de-
tectors shall be in accordance with the provisions of the 1976
Edition of the Uniform Building Code, Section 1310 for hotels,
motels, apartments and condominiums and Section 1413 for duplexes,
single family dwellings, lodging houses and mobile homes.
(a) The building owner or agent shall be
responsible for the installation.
(b) A no -fee permit shall be required for
the installation of smoke detectors.
Said permit may be obtained at the
Fire Inspection/Building Department,
City Hall.
(c) The building owner or agent shall pro-
vide or post within each Guest Room or
Dwelling Unit, written operating in-
structions and maintenance instructions
for the smoke detector installed there-
in.
Section 5. Maintenance of smoke detectors shall be
the responsibility of the tenant who shall maintain the device in
accordance to the instructions of the manufacturer. When an oc-
cupancy is vacated, the building owner or agent shall insure that
smoke detectors are operational prior to re -occupancy.
Section 6. Smoke detectors required by this Ordinance
shall be installed in all occupancies listed in Section 1 by not
later than 18 months after the adoption of this Ordinance.
Section 7. Any person violating any provision of this
Ordinance shall, upon conviction thereof, be punished by a fine
of not more than Three Hundred (300) Dollars.
Section 8. That this Ordinance shall take effect and
be in force five (5) days from and after its passage, approval
and publication as provided by 1 w.
