AN ORDINANCE of the City of Kent,
Washington, vacating a certain alley or
portion thereof in the City of Kent.

WHEREAS a proper application was filed by the City

of Kent for the vacation of a certain alley or portion thereof in

the City of Kent, and

WHEREAS thereafter, the Kent City Council did, by
a

resolution fix a time when said petition would be heard and deter
mined by the Kent City Council or a committee thereof, to -wit:
Monday, March 20, 1978, at the hour of 8 o'clock p.m. in the

Council Chambers of the City Hall of the City of Kent, Washing-
ton; and
WHEREAS after the passage of said motion, the City
Clerk of the City of Kent gave twenty (20) days notice of the
pendency of said petition by a written notice posted in three (3)
of the most public places in the City of Kent and a like notice
in conspicuous places on the alley sought to be vacated; said
notice containing the information required therein by the Laws of
the State of Washington and the ordinances of the City of Kent;
and
WHEREAS the Kent Planning Director has processed
said petition and secured the technical facts pertinent to the
question of said vacation which includes a sketch of the proposed
vacation and also written approval or rejection thereof by the
water, sewer and street departments of the City of Kent; and
WHEREAS the hearing on said petition was held in
the Council Chambers of the City Hall of the City of Kent at
8 o'clock p.m. on the 20th day of March, 1978, and it appearing
further that the granting of said petition for the vacation of
said alley or portion thereof will not be a menace or inconvience
to the traveling public or to any other persons using the streets
and alleys of the City of Kent, Washington.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
KENT, WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 2. The following described alley or portion
thereof within the City of Kent, Washington, and which is more
fully described herewith:
Approximately 16 feet in width and approx-
imately 124.70 feet in length of a dedi-
cated alley abutting Lots 1,2,7 and 8 in
Block 5, Clark's 2nd Addition to the Town
of Kent, according to plat thereof record-
ed in Volume 15 of Plats, Page 72, records
of King County, Washington, which is sub-
ject to existing utilities easements.
is hereby vacated.
Rection 3. Said vacation is subject to the follow-
ing conditions:
a) Retainage of utility easement for sanitary
sewers; such easement to be wide enough
for future reconstruction of the sewer line.
b) Retainage of a storm drainage easement for
storm water runoff; should the present open
drainage ditch be eliminated, the developer
of the property shall be required to provide
an alternate storm drainage system capable
of carrying the required storm water flow.
This system shall be subject to Engineering
Department review and approval.
Section 4. No vested rights shall be affected by
the provisions of this Ordinance.
Section 5. This Ordinance shall take effect and be
in force five (5) days from and after its passsge, approval and
publication as provided by law.
