ORDINANCE NO. ; 6 />__
AN ORDINANCE of the City of Kent,
Washington, providing for the condemna-
tion and acquisition of certain perma-
nent easements and temporary construction
easements in King County, Washington for
the purpose of providing right-of-way for
water mains to be installed as provided in
the City of Kent's Comprehensive Water
Plan.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
HEREBY ORDAIN AS FOLLOWS:
Section 1. That the City Attorney for the City of
Kent be and he is hereby authorized and directed to purchase and
or institute and prosecute to determination in the Superior Court
of the State of Washington, in the County of King, an action in
the name of the City of Kent for condemnation and acquisition of
easements across the following described land, situated in the
County of King, State of Washington, for the purpose of providing
right-of-way for water mains to be installed as provided in the
City of Kent's Comprehensive Water Plan.
PARCEL 1. (Palzer): The west 20 feet of Lot 15,
Derbyshire No. 4, according to the plat record-
ed in Volume 7 of Plats, Page 16, Records of
King County, Washington, as measured at right
angles to the west lines thereof, EXCEPTING
any portion thereof, lying within existing
improvements.
Together with a temporary construction easement described as fol-
lows:
The east 10 feet of the west 30 feet of Lot 15,
Derbyshire No. 4, according to Plat recorded in
Volume 70, Page 16, Records of King County,
Washington, as measured at right angles to the
west line thereof.
PARCEL 2. (King County): The west 20 feet of
Lot 15, Derbyshire No. 6, according to Plat
recorded in Volume 69, Page 93, Records of
King County, Washington, as measured at right
angles to the west line thereof.
Together with a temporary construction easement described as fol-
lows:
The east 10 feet of the west 30 feet of Lot 15,
Derbyshire No. 6, according to the Plat record-
ed in Volume 69 of Plats, Page 93, Records of
King County, Washington, as measured at right
angles to the west line thereof.

PARCEL 3. (Talbeck): The west 20 feet of that
portion of the southwest 1/4 of the northwest
1/4 of Section 28, Township 22 North, Range 5
East, W.M., in King County, Washington, lying
southerly of Kent Kangley Highway (S.S.H. #5-A),
except roads.
Together with a temporary construction easement described as fol-
lows:
The east 10 feet of the west 30 feet of that
portion of the southwest 1/4 of the northwest
1/4 of Section 28, Township 22 North, Range 5
East, W.M., in King County, Washington lying
southerly of the Kent Kangley Highway (S.S.H.
#5-A) except roads.
Section 2. That the acquiring of said easements for
the purpose herein mentioned is for a public use and necessity.
Section 3. The payment for the easements herein
described shall be made from the proceeds of the sale of 1976
City of Kent Water Revenue Bonds, and, if necessary, from other
City of Kent general funds allocated for the purpose.
Section 4. Nothing in this Ordinance shall be con-
strued as a waiver by the City of Kent of its rights to decline
to take and to pay for said land after the amount of damages has
been ascertained and within the time allowed by law.
Section 5. This Ordinance shall take effect and be
in force five (5) days from and after its passage, approval and
publication as provided by law. -0,1
