AN ORDINANCE of the City of Kent,
Washington, providing for the condemnation
and acquisition of certain land in King
County for the purpose of providing for
retention and holding ponds as an integral
part of the storm and surface water drain-
age system of the City of Kent, and pro-
viding for payment for said land.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
HEREBY ORDAIN AS FOLLOWS:
Section 1. That the City Attorney for the City of
Kent be and he is hereby authorized and directed to purchase and/
or institute and prosecute to determination in the Superior Court
of the State of Washington, in the County of King, an action in
the name of the City of Kent for condemnation and acquisition of
the following described land, situated in the County of King,
State of Washington, for the purpose of providing for retention
and holding ponds as an integral part of the storm and surface
water drainage system of the City of Kent.
PARCEL 3. (Hutchinson): Beginning at the
southwest corner of the east 18.6 feet of
the west half of the southwest quarter of
the northeast quarter of the southwest
quarter of Section 29, Township 22 North,
Range 5 East, Willamette Meridian, King
County, Washington, being the true point
of beginning of property herein described;
thence northerly along the west line thereof
a distance of 238.84 feet; thence southeast-
erly a distance of 308.48 feet to a point on
the south line of the southwest quarter of
the northeast quarter of the southwest quar-
ter in said section; which is 188.82 feet
easterly of the point of beginning; thence
west along said south line a distance of
188.82 feet to the true point of beginning.
PARCEL 4. (Monroe): That portion of the
south half of the northwest quarter of the
southeast quarter of the southwest quarter
of Section 29, Township 22 North, Range 5
East, Willamette Meridian, in King County,
Washington, described as follows:
Beginning at the southeast corner of the a-
bove described property being the true point
of beginning of property herein described;
thence north 89146151" west along the south
line thereof a distance of 110.00 feet; thence
north 50106141" west a distance of 518.57
feet to a point on the north line thereof;
thence south 89°51157" east along said north
line a distance of 497.90 feet to the north-
east corner of said subdivision; thence south
O1°43132" east along the east line thereof a
distance of 331.96 feet to the true point of
beginning.
PARCEL 11. (Holzboog): The west 65 feet of
the east 83.6 feet of the south 120 feet of
the north 234 feet of the west half of the
southwest quarter of the northeast quarter
of the southwest quarter of Section 29,
Township 22 North, Range 5 East, W.M., King
County, Washington, containing 7,800 square
feet, more or less.
TOGETHER WITH A TEMPORARY CONSTRUCTION EASE-
MENT to be used in conjunction with the con-
struction of the City of Kent's Upper Mill
Creek Detention Basin over the following de-
scribed property in King County, Washington:
The west 5 feet of the east 88.6 feet of the
south 120 feet of the north 234 feet of the
west half of the southwest quarter of the
northeast quarter of the southwest quarter
of Section 29, Township 22 North, Range 5
East, W.M., King County, Washington contain-
ing 600 square feet, more or less.
PARCEL 12. (Wilson): The north 114 feet of
the west half of the southwest quarter of
the northeast quarter of the southwest quar-
ter of Section 29, Township 22 North, Range
5 East, W.M., King County, Washington; EXCEPT
the east 18.6 feet thereof; AND EXCEPT the
west 30 feet thereof conveyed to King County
for road purposes.
Beginning at the southeast corner of the
above described tract; being true point of
beginning of property herein described;
thence west along the south line of said
tract a distance of 100.02 feet; thence
north 01030150" west 26 feet; thence north
18°57'13" east a distance of 93.13 feet to
the north line of said tract; thence north
89052132" east along the north line of said
tract to the northeast corner thereof;
thence south 01030150" east along the east
line of said tract a distance of 114 feet
to the true point of beginning. Contain-
ing 9,860 square feet, more or less.
TOGETHER WITH A TEMPORARY CONSTRUCTION
EASEMENT to be used in conjunction with
the construction of the City of Kent Upper
Mill Creek Detention Basin over the follow-
ing described property in King County, Wash-
ington:
Beginning at the southeast corner of the a-
bove described tract; thence west along the
south line of said tract a distance of 100.02
feet; thence north 01°30150" west 21 feet,

being true point of beginning of property
herein described; thence continuing north
O1°30'50" west 5 feet; thence north 18°57'
13" east a distance of 93.13 feet to the
north line of said tract; thence south 890
52132" west along the north line of said
tract a distance of 5.29 feet; thence south
18157113" west 8 feet; thence south 65°40100"
west 45 feet; thence south 24020100" east
20 feet; thence north 65040100" east 26.16
feet; thence south 18057113" west 62.94 feet;
thence north 89052132" east a distance of
7.14 feet more or less to the true point of
beginning.
PARCEL 14. (Hutchinson): The north 10 feet
of the west 8.60 feet of the east 18.6 feet
of the west half of the southwest quarter of
the northeast quarter of the southwest quar-
ter of Section 29, Township 22 North, Range
5 East, W.M., King County, Washington.
Section 2. That the acquiring of said land for the
purpose herein mentioned is for a public use and necessity.
Section 3. The payment for the land herein described
to be acquired shall be made from Federal Revenue Sharing Funds,
and, if necessary, from other City of Kent general funds allo-
cated for the purpose.
Section 4. Nothing in this Ordinance shall be con-
strued as a waiver by the City of Kent of its rights to decline
to take and to pay for said land after the amount of damages has
been ascertained and within the time allowed by law.
section 5. This Ordinance shall take effect and be
in force five (5) days from and after its passage, approval and
publication as provided by law.
