HomeMy WebLinkAbout2027ORDINANCE NO. va AN ORDINANCE of the City of Kent, Washington, amending Sections 3 and 4 of �I Ordinance 1674 relating to terms of office 1-�- and meetings of the Kent Planning Commis- sion. THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO HEREBY ORDAIN AS FOLLOWS: Section 1. Section 3 of Ordinance 1674 which reads as follows: "Section 3. Membership, Terms, Residence Requirements, Compensation of the Commission. The Commission shall' consist of nine (9) appointed members, each of which shall be appointed by the Mayor and confirmed by the City Council. Ex officio members of the Commission shall consist of the City Engineer and City Attorney, which members shall not have a vote. The term of office of the first three Commissioners appointed following the adoption of this Ordinance shall expire July 1, 1972; the terms of office of the second three Commissioners appointed following the a- doption of this Ordinance shall expire July 1, 1973; the terms of office of the final three Commissioners appointed after the adoption of this Ordinance shall expire July 1, 1974. After the effective date of this Ordinance, when a vacancy occurs on the Commis- sion, appointment for that position shall be for four', (4) years, or for the remainder of the unexpired term,l whichever is the shorter period of time. Members of the Commission may be dismissed by the Mayor, with approval of the City Council, for the rea-i. sons of neglect of duty, for missing twenty-five per- cent (25%) of the regularly scheduled meetings in a twelve (12) month period, inefficiency or malfeasance in office. At least five (5) persons appointed to serve on the Commission shall reside within the corporate limits of the City of Kent, and the others at least within an area designated by the City Council as being within the sphere of interest of the City. The appointive members of the Commission shall serve without compensation except that reimbursement for authorized travel expenses may be made. Reimbursement for such travel expenses shall come from the budget category designated "Planning Commission" which cat- egory may be part of the annual Planning Department's authorized budget." is hereby amended to read as follows: "Section 3. The Secretary shall prepare the Commission g agenda, prepare minutes and keep such records as are necessary for the proper operation of the Commission,' ii all of which will be a matter of public record. The Commission shall meet at least once each month and shall operate under a set of by-laws, which by- laws shall prescribe the rules of procedure and dates of meetings of the Commission." is hereby amended to read as follows: "Section 4. The Secretary of the Manning Commission shall be the Planning Di- rector. The Secretary shall prepare the Commission agenda, prepare minutes and keep such records as are - 2 - necessary for the proper operation of the Commission,) all of which will be a matter of public record. The Commission shall meet at least once each month and shall operate under a set of by-laws, which by- laws shall prescribe the rules of procedure and dates' of meetings of the Commission. The Commission shall have the authority to include within its by-laws provisions for a monetary penalty to be imposed upon persons who have applications pending before the Commission and who fail, other than for just cause, to appear before the Commission at any regular or special meeting of the Commission at which such application is scheduled for public hearing. The fine shall not exceed $25.00. The Chairman shall have sole authority to determine whether there was just cause for failure of an appli cant to appear, provided, however, that in the event of the absence of the Chairman the Vice -Chairman or Chairman pro -tem shall also have such authority. The; decision as to whether a fine shall be imposed shall be final and not appealable." Section 3. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as provided by law.
