AN ORDINANCE of the City of Kent, Wash- ington, vacating certain streets and portions thereof within the City limits of the City of Kent. WHEREAS, a proper application was filed by the City of Kent for the vacation of dedicated public streets or portions thereof of the City of Kent, and WHEREAS, thereafter, the Kent City Council did, by Resolution fix a time when said Petition would be heard and deter- mined by the Kent City Council or a committee thereof, to -wit: Monday, July 19, 1976, at the hour of 8:00 o'clock p.m. in the Council Chamber of the City Hall of the City of Kent, Washington; and WHEREAS, after the passage of said motion, the City Clerk of the City of Kent gave twenty(20) days notice of the pendency of said Petition by a written notice posted in three (3) of the most public places in the City of Kent and a like notice in conspicuous places on the streets or portions thereof sought to be vacated; said notice containing the information required therein by the Laws of the State of Washington and the Ordinances of the City of Kent; and WHEREAS, the Kent City Attorney has processed said Petition and secured the technical facts pertinent to the question of said vacation which includes a sketch of the proposed vacation and also written approval or rejection thereof by the water, sewer and street departments of the City of Kent; and WHEREAS, the hearing on said Petition was held in the Council Chambers of the City Hall of the City of Kent at 8:00 o'clock p.m. on the 19th day of July, 1976, and it appearing fur- ther that the granting of said Petition for the vacation of such streets or portions thereof will not be a menace or inconvenience to the traveling public or to any other persons using the streets of the City of Kent, Washington, ll U1% CO r__ C) c� t�- C'3 t�- o co 0 a ,,r a Ike r_ +tea rn .:J ORDINANCE NO. The following described streets or portions thereof more fully described herewith: Parcel 1 That portion of 44th Avenue South as dedicated within the plat of Green Valley Heights #6 as recorded in Volume 85 of Plats, Pages 59 and 60, records of King County, Washington more par- ticularly described as follows: Beginning at the northeast corner of Lot 22 in said plat being the true point of beginning of property herein described; thence south 89° 10' 32" east a distance of 14.63 feet; thence south 16° 28' 46" west a distance of 55.71 feet to a point on the east line of said lot; thence north 1° 15' 19" east along the east line thereof a distance of 53.64 feet to the true point of be- ginning. Containing 392.34 square feet. Parcel 2 That portion of that certain unnamed cul-de-sac as dedicated and adjoining 44th Avenue South in the Plat of Green Valley Heights #6 as recorded in Volume 85 of Plats, Pages 56 and 60, records of King County, Washington, more particularly described as follows: Beginning at the northeast corner of Lot 22 in said plat, thence south 891 10' 32" east a dis- tance of 14.63 feet; thence south 161 28' 46" west a distance of 89.68 feet to a point on a curve being the true point of beginning of prop- erty herein described; thence on a curve to the right with a radius of 20 feet, an arc length of 11.74 feet to a point of tangency; thence north 880 44' 41" west a distance of 20 feet to a point of curvature; thence on a curve to the left with a radius of 45 feet, an arc distance of 141.37 feet to a point of tangency; thence south 88° 44' 41" east a distance of 5.67 feet; thence north 16° 28' 46" east a distance of 96.74 feet to the true point of beginning. Reserving, however, an easement for water to the City of Kent and its assigns. Containing 4,803.51 square feet. Parcel 3 That portion of South 253rd Street as dedicated within the plat of Green Valley Heights #6 as - 2 - U-) 1'00" 0 O r- CD �D N recorded in Volume 85 of plats, pages 59 & 60, King County, Washington, more particularly described as follows: Beginning at the northeast corner of Lot 22 within said plat; thence south 89° 10' 32" east a distance of 14.63 feet; thence south 16° 28' 46" west a distance of 459.33 feet to a point of curvature; thence on a curve to the right with a radius of 683.20 feet, an arc distance of 83.94 feet to the true point of beginning of property herein described; thence continuing on said curve to the right an arc distance of 7.41 feet to a point of tangency; thence south 740 58' 56" west a distance of 14.14 feet; thence north 600 01' 04" west a distance of 12.37 feet; thence on a curve to the left with a radius of 180 feet, an arc distance of 58.81 feet to a point on the south line of Lot 32 in said plat; thence easterly along the south line thereof and the south line of Lot 31 in said plat to the true point of beginning. Containing 435.50 square feet. are hereby vacated with the City of Kent reserving an easement for water line over and across Parcel 2 with the right to enter upon said easement for maintenance and repair work to any utilities located therein without incurring any liability for damage to improvements therein. Section 2. No vested rights shall be affected by the provisions of this Ordinance. Section 3.
