HomeMy WebLinkAbout1952ORDIN ORDINANCE NO. 16sz EA LED =Y AN ORDINANCE of the City of Kent, Wash- ington, creating a Traffic Violations Bureau, establishing its duties, providing for en- forcement and penalties for violation, and repealing Ordinance 1171. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. TRAFFIC VIOLATIONS BUREAU CREATED. The Kent Traffic Violations Bureau is hereby establish- ed. The Bureau shall operate under the auspices of the Kent Police Department in conjunction with the Aukeen District Court. The Bureau shall be staffed by such persons and shall be open at such hours as are designated by the Chief of Police. Section 2. POSTING OF BAIL WITH TRAFFIC VIOLATIONS BUREAU - FORFEITURES. The Judges of the Aukeen District shall designate the offenses under the traffic ordinances of the City of Kent to which posting of bail may be accepted by the Traffic Violations Bureau; and they may further prescribe by regulation, the offenses and the circumstances for which such bail may be forfeited by the person charged with such an offense. PROVIDED, that this Section shall not preclude a person charged with an offense from requesting a trial as authorized by law. Section 3. DUTIES OF TRAFFIC VIOLATIONS BUREAU. Duties of the Traffic Violations Bureau shall include among other the following: (a) It shall accept designated bail from and issue receipts to such violators as are permitted to and desire to forfeit bail. (b) It shall accept designated bail from and issue receipts to all persons who must or wish to be heard in Court, enter the time of appearance on the Court Docket, and notify the arresting officer and witnesses, if any, to be present at the trial. (c) It shall keep a proper and complete record of all bail forfeiture in cases wherein any person has been charged with violation of the traffic ordinances of the City of Kent, together with a record of the final disposition of all such alleged offenses and violations. (d) It shall issue to individual police officers, serially numbered citation forms for the pur- pose of notifying or citing any person or persons charged with the violation of any traffic ordinances of the City of Kent of the nature of the charge; and it shall keep a complete record of all such forms issued, including any forms spoiled or upon which an entry has been made but not issued to an al- leged violator. Such citation forms numbered serially in quadruplicate shall be furnished to the Traffic Violations Bureau by the Chief of Police of the City of Kent. (e) All police and other law enforcement officers of the City of Kent issuing such a citation or notice to an alleged offender of any of the traffic ordinances of the City of Kent shall deposit a copy of said citation with the Traffic Violation Bureau within 48 hours of the issuance thereof. Section 4. VIOLATION - PENALTY Any person who fails to appear after signing a written promise to appear shall be guilty of a violation of this Ordi- nance, regardless of the charges for which the notice was orig- inally issued, and shall upon conviction thereof be fined in a sum not exceeding five hundred dollars or imprisonment for a per- iod not exceeding six months or both such fine and imprisonment. Section 5. Ordinance No. 1171 of the City of Kent and any ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6.
