HomeMy WebLinkAbout1938ORDINANCE NO. AN ORDINANCE of the City of Kent, Wash- ington, vacating a certain alley within the city limits of the City of Kent. WHEREAS, a proper application was filed by the City of Kent for the vacation of dedicated public alley of the City of Kent, and WHEREAS, thereafter, the Kent City Council did, by Resolution fix a time when said Petition would be heard and deter- mined by the Kent City Council or a committee thereof, to -wit: Monday, August 4, 1975, at the hour of 8:00 o'clock P.M. in the Council Chambers of the City Hall of the City of Kent, Washington; and WHEREAS, after the passage of said motion, the City Clerk of the City of Kent gave twenty (20) days notice of the pendency of said Petition by a written notice posted in three (3) of the most public places in the City of Kent and a like notice in conspicuous places on the alley sought to be vacated; said notice containing the information required therein by the Laws of the State of Washington and the Ordinances of the City of Kent; and WHEREAS, the Kent Planning Director has processed said Petition and secured the technical facts pertinent to the question of said vacation which includes a sketch of the proposed vacation and also written approval or rejection thereof by the water, sewer and street departments of the City of Kent; and WHEREAS, the hearing on said Petition was held in the Council Chambersof the City Hall of the City of Kent at 8:00 o'clock P.M. on the 4th day of August, 1975, and it appearing further that the granting of said Petition for the vacation of said alley will not be a menace or inconvenience to the traveling public or to any other persons using the streets and alleys of the City of Kent, Washington, Ln 1..0 Lf ) Q t?` O tl') tom - NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The following described alley within the City of Kent, Washington, and which is more fully described here- with: That certain dedicated alley lying within Block 3, Guibersons Addition, as recorded in Volume 14 of Plats, page 49, records of King County, Washington. is hereby vacated with the City of Kent reserving a twelve (12) foot utilities easement with the right to enter upon said ease- ment for maintenance and repair work to any utilities located therein without incurring any liability for damage to improve- ments therein. Section 2. No vested rights shall be affected by the provisions of this Ordinance. II Section 3.
