ORDINANCE NO. 1900
AN ORDINANCE of the City of Kent, Wash-
ington, vacating a certain street within the
city limits of the City of Kent.
WHEREAS, a proper application was filed by the City of
Kent for the vacation of a portion of Cemetery Road, a public
street of the City of Kent, and
WHEREAS, thereafter, the Kent City Council did, by
Resolution fix a time when said Petition would be heard and deter-
mined by the Kent City Council or a committee thereof, to -wit:
Monday, June 3, 1974, at the hour of 8:00 o'clock P.M. in the
Council Chambers of the City Hall of the City of Kent, Washington;
and
WHEREAS, after the passage of said motion, the City
Clerk of the City of Kent gave twenty (20) days notice of the pen-
dency of said Petition by a written notice posted in three (3)
of the most public places in the City of Kent and a like notice
in conspicuous places on the street sought to be vacated; said
notice containing the information required therein by the Laws of
the State of Washington and the Ordinances of the City of Kent;
and
WHEREAS, the Kent City Engineer has processed said Peti-
tion and secured the technical facts pertinent to the question of
said vacation which includes a sketch of the proposed vacation
and also written approval or rejection thereof by the water, sewer
and street departments of the City of Kent; and
WHEREAS, thereafter said Petition, along with said
technical information, was referred to the Planning Commission of
the City of Kent for consideration at its next regular meeting;
said Planning Commission recommending favorably on said Petition;

WHEREAS, thereafter the hearing on said Petition was
held in the Council Chambers of the City Hall of the City of Kent
at 7:00 o'clock P.M. on the 3rd day of June, 1974, and it appear-
ing further that the granting of said Petition for the vacation of
said street will not be a manace or inconvenience to the traveling)
public or to any other persons using the streets and alleys of the
City of Kent, Washington,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The following described street within the
City of Kent, Washington, and which is more fully described here-
with:
That portion of the SW 1/4 of the NW 1/4
of Section 19, Township 22 North, Range 5
East, W.M. described as follows: Beginning
at the intersection of Jason Avenue North
and East Smith Street, thence south 89°14'
09.2" east 25 feet, thence south 0045'50.8"
west 250.91 feet to the true point of be-
ginning, thence south 0145'50.8" west 98.59
feet, thence in a southeasterly direction
along a curve to the left having a radius
of 125 feet and a central angle of 64°15'18.1"
a distance of 140.18 feet, thence in a westerly
direction along a curve to the right having a
radius of 120 feet and a central angle of
19°29159.6" a distance of 40.84 feet, thence
north 60015104.4" west 82.27 feet, thence in
a northerly direction along a curve to the
right having a radius of 175 feet and a cen-
tral angle of 19048148.6" a distance of 60.51
feet, thence north 0145150.8" east 8.34 feet,
thence north 29044'55.6" east 103.19 feet to
the true point of beginning.
is hereby vacated with the City of Kent reserving any necessary
utilities easements.
Section 2. No vested rights shall be affected by the
provisions of this Ordinance.
Section 3. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication as provided by law.
