AN ORDINANCE of the City of Kent, Wash-
ington creating a special fund to be known as
the "Motor Vehicle Intoxication Fund" as pro-
vided under Chapter 130, Laws of 1974, Third
Extraordinary Session.
WHEREAS, the Legislature of the State of Washington by
the adoption of Chapter 130, Laws of 1974, Third Extraordinary
Session, has established a penalty assessment for persons who are
fined or who forfeit bail for the offenses of driving a motor ve-
hicle while under the influence of intoxicating liquor or being
in actual physical control of a motor vehicle while under the in-
fluence of intoxicating liquor, and
WHEREAS, said legislative enactment provided for trans-
mittal of penalty.assessments to City or County Treasurers and
further provided that separate funds be established by City and
County Treasurers for receipt of said penalty assessments and for
transmittal of said penalty assessments to the Highway Safety
Fund of the State Treasury, NOW, THEREFORE
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO
HEREBY ORDAIN AS FOLLOWS:
Section 1. There is hereby created a special fund in
the City of Kent, Washingtakn., to be known as the Motor Vehicle
Intoxication Fund.
Section 2. All monies received by the City Treasurer
as penalty assessments under the provisions of Chapter 130, Laws
of 1974, Third Extraordinary Session shall be deposited in said
Fund.

Section 3. The City Treasurer shall transmit to the
State Treasurer monthly and without deduction the gross amount of
such penalty assessments received for credit to the Highway Safet
Fund of the State Treasury.
Section 4. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication, as provided by law.
