AN ORDINANCE of the City of Kent, Wash- ington, approving and confirming the assess- ments and assessment roll of Local Improve- ment District No. 262, which has been created and established for the purpose of improving West Gowe Street from South Fourth Avenue to South Sixth Avenue and South Sixth Avenue from West Gowe Street to West Meeker Street by constructing approximately 1115 lineal feet of two (2) lane street, with curb and gutter, storm drains, illumination, land- scaping, underground power and communica- tions, and an improved railroad crossing with cantilever signal lights, as provided by Ordinance No. 1760 and levying and as- sessing the amount thereof against the several lots, tracts, parcels of land and other properties shown on the roll. WHEREAS, the assessment roll levying the special assess- ments against properties located in Local Improvement District No. 262 in the City of Kent, Washington, created under Ordinance No. 1760, has been filed with the Clerk of the City of Kent, as provided by law; and WHEREAS, notice of the time and place of hearing there- on and of making objections and protests to the roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 15th day of October, 1973, at the hour of 8:00 o'clock p.m. (PDST), in the Council Chambers of the City Hall in the City of Kent, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on that roll; and WHEREAS, at the time and place fixed and designated in that notice, the hearing was duly held and no written protests were received, and all persons appearing at the hearing were heard; -1- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. The assessments and assessment roll of Local Improvement District No. 262 which has been created and es- tablished for the purpose of improving West Gowe Street from South Fourth Avenue to South Sixth Avenue and South Sixth Avenue from West Gowe Street to West Meeker Street by construcing ap- proximately 1,115 lineal feet of two (2) lane street, with curbs and gutters, sidewalks, storm drains, illumination, landscaping, underground power and communication systems, and an improved railroad crossing with cantilever signals, as provided by Ordinance No. 1760, as the same now stands, be and the same are hereby in all things and respects approved and confirmed in the total amount of $30,681.92. Section 2. Each of the lots, tracts, parcels of land and other property shown upon the roll is hereby determined and declared to be specially benefited by the improvements in at least the amount charged against the same and the assessment ap- pearing against the same is in proportion to the several assess- ments appearing upon the roll. There is hereby levied and assess ed against each lot, tract, parcel of land and other property ap- pearing upon the roll the amount finally charged against the same thereon. Section 3. The assessment roll as approved and confirm- ed shall be filed with the Treasurer of the City of Kent for col- lection, and the City Treasurer is hereby authorized and directed to publish notice as required by law stating that the roll is in her hands for collection and payment of any assessment thereon or any portion of that assessment can be made at any time within thirty (30) days from the date of the first publication of the notice without penalty, interest or cost, and that thereafter the sum remaining unpaid may be paid in ten (10) equal annual install l ments with interest thereon hereby fixed at the rate of Crr /j z a per annum. The first installment of assessments on the assessmen roll shall become due and payable during the thirty (30) day period succeeding the date one (1) year after the date of first -2- publication by the City Treasurer of notice that the assessment roll is in her hands for collection and annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessments remains unpaid after the first thirty (30) day period, interest/ upon the whole unpaid sum shall be charged at the rate of (�2 /� per annum and each year thereafter one of the installments, together with interest due on the whole unpaid balance, shall be collected. Any installment not paid prior to the expiration of the thirty (30) day period during which such installment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest of 77. per annum and for an additional charge of 6% penalty levied upon both principal and interest due upon such installment or installments. The col- lection of such delinquent installments will be enforced in the manner provided by law. Section 4.
