HomeMy WebLinkAbout1825J/ ORDINANCE NO. t r V AN ORDINANCE of the City of Kent, Wash- ington, providing for the condemnation and acquisition of certain land in the City of Kent for the purpose of providing for a pub- lic park, and providing for payment for said land. THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the City Attorney for the City of Kent be and he is hereby authorized and directed to purchase and/or in- stitute and prosecute to determination in the Superior Court of the State of Washington, in the County of King, an action in the name of the City of Kent for condemnation and acquisition of the following described land, situated in the City of Kent, County of King, State of Washington, for the purpose of providing for a public park, to -wit: PARCEL 1. (Gould): Beginning at a point which is 864 feet east from the northwest corner of the southwest quarter of the southeast quarter of Section 19, Township 22 North, Range 5 E.W.M., in King County, Washing- ton, running thence east 450 feet; thence south- easterly along the County Road 825 feet; thence west 950 feet; thence north 655 feet to the be- ginning; containing 12 acres, more or less; pro- vided that that portion of that certain tract deeded to the Town of Kent by Gottlieb Eggler, Maria 0. Eggler, Joseph W. Eggler, etc., in- cluded within the above described boundaries is excepted from this description and provided further that the following tract to -wit: Beginning 1814 feet east of the west line and 660 feet north of the south line of the southeast quarter of Section 19; thence west 494 feet; thence north 440 feet to the County Road; thence southeasterly along the said County Road 600 feet, more or less, to the beginning, is also excepted from this description; ALSO EXCEPT that portion thereof conveyed to the State of Washington under Auditor's File No. 4244810 for Secondary State Highway No. 5-A, AND Beginning on the west line of County Road 825 feet southeasterly from the north line of the southwest quarter of the southeast quarter of Section 19, Township 22 North, Range 5 E.W.M., in King County, Washington; thence west 950 feet; thence south to a point 15 feet north of the north line of the southeast quarter of the southwest quarter of the southeast quarter; thence east to said County Road; thence northwesterly along said County Road to beginning; EXCEPT that portion thereof conveyed to the Town of Kent under Auditor's File No. 575539; and EXCEPT that portion thereof in the southeast quarter of the southeast quarter of said Sec- tion 19, AND South 15 feet of the northeast quarter of the southwest quarter of the southeast quarter of Section 19, Township 22 North, Range 5 E.W.M., in King County, Washington; EXCEPT that portion conveyed to the Town of Kent under Auditor's File No. 575539. PARCEL 2. (Collins): That portion of the south 630 feet of the south- east quarter of the southwest quarter of the southeast quarter of Section 19, Township 22 N., 5 E.W.M., in King County, Washington, lying easterly of the plats of Armscrest No. 5, according to plat recorded in Volume 78 of Plats, page 86, in King County, Washington, and Armscrest No. 6, according to plat recorded in Volume 81 of Plats, page 79, records of said county, AND The southeast quarter of the southwest quarter of the southeast quarter of Section 19, Township 22 North, Range 5 E.W.M., in King County, Wash- ington, EXCEPT the south 630 feet, ALSO EXCEPT that portion lying southwesterly of the northeasterly line of the plat of Armscrest No. 5, as recorded in Volume 78 of Plats, page 86, in King County, Washington. Section 2. That the acquiring of said land for the purpos( herein mentioned is for a public use and necessity. Section 3. The payment for land herein described to be acquired shall be made from funds provided by the United States -2- Department of Housing and Urban Development, by the Inter -Agency Corporation of the State of Washington and from Forward Thrust or City of Kent funds allocated for the purpose. Section 4. Nothing in this Ordinance shall be construed as a waiver by the City of Kent of its right to decline to take and to pay for said land after the amount of damages has been as- certained and within the time allowed by law. Section 5. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and pub- lication as provided by law.
