AN ORDINANCE approving and confirming the assessments and assessment roll of Local Improvement District No. 272, which has been created and established for the purpose of improving an area of the City by the con- struction and installation of asphaltic concrete surface on 84th Avenue South to provide four (4) through traffic lanes with a fifth (5th) lane to provide a two-way left turn lane and a channelization and signalization at South 212th Street and South 228th Street, together with the con- struction and installation of curbs and gutters, storm drains, illumination and underground power, as provided by Ordinance No. 1757, and levying and assessing the amount thereof against the several lots, tracts, parcels of land and other property shown on the roll. WHEREAS, the assessment roll levying the special assess- ments against properties located in Local Improvement District No. 272 in the City of Kent, Washington, created under Ordinance No. 1757, has been filed with the City Clerk of the City of Kent, Washington, as provided by law; and WHEREAS, notice of the time and place of hearing thereon and of making objections and protests to the roll was duly pub- lished at and for the time and in the manner provided by law, fix- ing the time and place of hearing thereon for the 16th day of October, 1972, at the hour of 8:00 o'clock p.m. (PDST), in the Council Chambers in the City Hall, Kent, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on the roll; and WHEREAS, at the time and place fixed and designated in the notice, the hearing was duly held. Written protests were re- ceived, all persons appearing at said hearing were heard, and all protests were denied; NOW, THEREFORE -1- THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN, AS FOLLOWS: Section 1. The assessments and assessment roll of Local Improvement District No. 272, which has been created and establi- shed for the purpose of improving an area of the City by the con- struction and installation of asphaltic concrete surface on 84th Avenue South to provide four (4) through traffic lanes with a fift (5th) lane to provide a two-way left turn lane and a channeliza- tion and signalization at South 212th Street and South 228th Street, together with the construction and installation of curbs and gutters, storm drains, illumination and underground power, as provided by Ordinance No. 1757, as the same now stand, be and the same are hereby in all things and respects approved and confirmed in the total amount of $66,233.90. Section 2. Each of the lots, tracts, parcels of land and other property shown upon the roll is hereby determined and declared to be specially benefited by said improvement in at least the amount charged against the same and the assessment appearing upon said roll. There is hereby levied and assessed against each lot, tract, parcel of land and other property appearing upon said roll the amount finally charged against the same thereon. Section 3. The assessment roll as approved and con- firmed shall be filed with the Treasurer of the City of Kent for collection, and the City Treasurer is herby authorized and directed to publish notice as required by law stating that the roll is in her hands for collection and payment of any assessment thereon or any portion of the assessment can be made at any time within thirty (30) days from the date of the first publication of said notice without penalty, interest or cost, and that thereafter the sum remaining unpaid may be paid in ten equal annual installments with interest thereon hereby fixed at the rate of 6-1/2% per annum. The first installment of assessments on the assessment roll shall become due and payable during the thirty -day period succeeding the date one year after the date of first publication by the City Treasurer of notice that the assessment roll is in her hands for -2- collection and annually thereafter each succeeding installment shall become due and payable in like manner. If the whole or any portion of the assessments remains unpaid after the thirty -day period, interest upon the whole unpaid sum shall be charged at the rate of 6-1/2% per annum and each year thereafter one of the in- stallments, together with interest due on the whole of the unpaid balance, shall be collected. Any installment not paid prior to the expiration of the thirty -day period during which such install- ment is due and payable shall thereupon become delinquent. All delinquent installments shall be subject to a charge for interest at 6-1/2% per annum and for an additional charge of 6% penalty levied upon both principal and interest due upon such installment or installments. The collection of such delinquent installments will be enforced in the manner provided by law.
