AN ORDINANCE of the City of Kent, Wash-
ington providing for condemnation and acqui-
sition of certain land in the City of Kent
for the purpose of improving and widening
S. E. 256th Street, a public highway in the
City of Kent, and providing for payment for
said land.
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DO
ORDAIN AS FOLLOWS:
Section 1. That the City Attorney for the City of Kent
be and he is hereby authorized and directed to purchase and/or
institute and prosecute to determination in the Superior Court of
the State of Washington, in the County of King, an action in the
name of the City of Kent for condemnation and acquisition of the
following described land, situated in the City of Kent, County of
King, State of Washington, for the purpose of improving and widen-
ing S. E. 256th Street, a public highway in the City of Kent, to -wit:
PARCEL 7. (Texaco)
That portion of the southeast quarter of the south-
west quarter of the southwest quarter of Section 20,
Township 22 North, Range 5 East, W.M., in King County,
Washington, described as follows:
Beginning at the intersection of the northerly margin
of the Kent -Black Diamond Road (Secondary State High-
way No. 5A) with the westerly margin of the Kent -
Renton Road (Secondary State Highway No. 5C) which
point is 30 feet north and 30 feet west of the south-
east corner of said subdivision;
thence northerly along the westerly margin of said
Kent -Renton Road a distance of 120 feet;
thence westerly, parallel to the northerly margin of
said Kent -Black Diamond Road, a distance of 120 feet;
thence southerly parallel to said Kent -Renton Road, a
distance of 120 feet to an intersection with the northerly
margin of the Kent -Black Diamond Road,
thence easterly along the said northerly margin to the
point of beginning.

PARCEL 8. (Atlantic Richfield)
The west 220 feet of the south 210 feet of the south-
east quarter of the southwest quarter of Section 20,
Township 22 north, Range 5 East, W.M., in King County,
Washington;
EXCEPT portion condemned in King County Superior Court
Cause No. 182808 for A. J. Biggar Road;
EXCEPT portions conveyed to King County for road by
deed recorded under Auditor's File No. 2158358;
EXCEPT portions condemned for Julius Johnson County
Road No. 362; in King County Superior Court Cause
No. 15732;
EXCEPT that portion conveyed to King County for 104th
Avenue Southeast by deed recorded under Auditor's File
No. 5321325; AND
EXCEPT County Road.
PARCEL 9. (East Hill Associates)
That portion of the west half of the southeast quarter
of the southwest quarter of Section 20, Township 22
North, Range 5 East, W.M., in King County, Washington,
described as follows:
Beginning at the brass -ap monument marking the south-
west corner of said subdivision;
thence south 88°38' east along the southerly line of
said subdivision 220.03 feet;
thence north 02114' 39" east parallel to the westerly
line of said subdivision 30 feet to the northerly
margin of S. E. 256th Street and the true point of
beginning;
thence continuing north 02014139" east 10 feet;
thence south 88038' east parallel to said northerly
margin 100 feet;
thence south 02014'39" west 10 feet to said northerly
margin;thence north 88138' west along said northerly
margin 100 feet to the true point of beginning.
Section 2. That the acquiring of said land for the purpose
herein mentioned is for a public use and necessity.
Section 3. The payment for the land herein described to
be acquired shall be made from funds provided from the City of Kent
Street Fund.
Section 4. Nothing in this Ordinance shall be construed
as a waiver by the City of Kent of its right to decline to take and
to pay for said land after the amount of damages has been ascer-
tained and within the time allowed by law.

Section 5. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication as provided by law.
