HomeMy WebLinkAbout1739ORDINANCE NO. r (� fiP0 U AN ORDINANCE of the City of Kent, Wash- ington, amending Ordinance 1593 by adding new j sections thereto and by re -numbering existing ii sections thereof. j THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: �I i Section 1. There is hereby added to Ordinance 1593 a j new Section designated as Section 8 which shall read as follows: Modifications: The Chief of the Bureau of Fire Prevention shall have power to modify any of the provisions of this Ordinance upon ap- plication in writing by the owner or lessee, or his duly authori- zed agent, when there are practical difficulties in the way of carrying out the strict letter of the Ordinance provided that the ,spirit of the Ordinance shall be observed, public safety secured and substantial justice done. The particulars of such modifica- tions when granted or allowed and the decision of the Chief of the Bureau of Fire Prevention thereon shall be entered upon the re- cords of the department and a signed copy shall be furnished the ;applicant. S .qt -(--Finn i There is hereby added to Ordinance 1593 a new Section de- signated as Section 9 which shall read as follows: Appeals Whenever the Chief of the Bureau of Fire Prevention shall -1- ii 'disapprove an application or refuse to grant a permit applied for,: ,or when it is claimed that the provisions of this Ordinance do not! apply or that the true intent and meaning of the Ordinance have ,1been misconstrued or wrongly interpreted, the applicant may appeal! from the decision of the Chief of the Bureau of Fire Prevention to! j the City Council within 30 days from the date of the decision ap- pealed. Section 3. Section 8 of existing Ordinance 1593 which reads as follows: Unlawful Conduct i "It is unlawful for any person, firm, or corporation to 'i own, occupy, or use any building or structure as defined in Sec- tion 3.14.08, 3.14.12, 3.14.16, unless such building or structure is located within One Hundred Sixty-five (165) feet of any fire hydrant." Is hereby amended to read as follows: Unlawful Conduct "It is unlawful for any person, firm, or corporation to own, occupy, or use any building or structure as defined in Sec- tion 3.14.08, 3.14.12, 3.14.16, unless such building or structure is located within One Hundred Sixty-five (165) feet of any fire hydrant, unless modification has been granted by the Chief of the Bureau of Fire Prevention or upon appeal to the City Council as provided in Section 8". Section 8 of existing i P g Ordinance 1593 as �! amended shall be designated as Section 10 in this amended Ordi- nance. Section 4. Section 9 of existing Ordinance 1593 which reads as follows: Penaltv for Violation Any person violating any provision or term of this Chap- ter shall, upon conviction thereof, be punished by a fine of not -2- i i more than THREE HUNDRED (300.00) DOLLARS or by imprisonment for ii not more than Ninety (90) days, or by both such fine and imprison -i men t. jj is hereby reenacted in its entirety and designated as Section 11 in this amended Ordinance. �i Section 5. Repeal Any Ordinances or Codes of the City of Kent or any Sec- tions thereof previously adopted and inconsistent with the pro- visions of this Ordinance are hereby declared to be repealed. Section 6. This Ordinance shall take effect and be in j force five (5) days from and after its passage, approval and pub- lication, as provided by law.
