HomeMy WebLinkAbout1728il- C) CD ORDINANCE NO. 1I�L AN ORDINANCE of the City of Kent, Wash- ington, vacating a certain street or portion thereof within the city limits of the City of Kent. WHEREAS, the owners of more than two-thirds of the pro- perty abutting a certain street or portion thereof located in the ;City of Kent, King County, State of Washington, and which is more fully described hereafter, have petitioned the City Council to 'vacate said street; and WHEREAS, thereafter, the Kent City Council did, by motiol fix a time when said Petition would be heard and determined by the Kent City Council or a committee thereof, to -wit: Monday, June 7,! 1971, at the hour of 7:00 o'clock P.M. in the Council Chambers of ithe City Hall of the City of Kent, Washington; and WHEREAS, after the passage of said motion, the City Clerk !of the City of Kent gave twenty (20) days notice of the pendency !!of said Petition by a written notice posted in three (3) of the !most public places in the City of Kent and a like notice in con- spicuous places on the street sought to be vacated; said notice containing the information required therein by the Laws of the 'State of Washington and the Ordinances of the City of Kent; and WHEREAS, the Kent City Engineer has processed said Pe- tition and secured the technical facts pertinent to the question of said vacation which includes a sketch of the proposed vacation and also written approval or rejection thereof by the water, sewer and street departments of the City of Kent; and WHEREAS, thereafter said Petition, along with said tech- nical information, was referred to the Planning Commission of the City of Kent for consideration at its next regular meeting; said Planning Commission recommending favorably on said Petition; and -1- C7� CD v CD `. WHEREAS, thereafter the hearing on said Petition was !held in the Council Chambers of the City Hall of the City of Kent jat 7:00 o'clock P. M. on the 7th day of June, 1971, and it ap- I gearing further that the granting of said Petition for the vaca- tion of said street will not be a manace or inconvenience to the 1 traveling public or to any other persons using the streets and alleys of the City of Kent, Washington, I NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO ORDAIN AS FOLLOWS: j Section 1. The following described street.within the I !City of Kent, Washington, and which is more fully described here- ' with: That portion of South 234th Street (August Sarin Road) lying westerly of Primary State Highway No. 5 and easterly of 5th Avenue North (also August Sarin Road and 76th Avenue South) situated in the Southeast quarter of Section 13, Township 22 North, Range 4 East, W. M. is hereby vacated and will hereafter belong to the abutting pro- perty owners one-half (1/2) to each. Section 2. No vested rights shall be affected by the provisions of this Ordinance. Section 3. The City retains an easement or the right to exercise and grant easements in respect to the vacated street for the construction, repair and maintenance of public utilities and services. I Section 4.
