Iq AN ORDINANCE relating to planning and rezoning for land use and development in the city of Kent, Washington, and rezoning a por- tion of certain property originally zoned by the City of Kent by Ordinance No. 1071, as M -A (Industrial -Agricultural) zone to M-1 (Light Industrial) zone. - WHEREAS, certain land was originally zoned by the City of Kent by Ordinance No. 1071, as amended, entitled "zoning Ordinance for the City of Kent, Washington", passed by the City Council on the 15th day of September, 1960, and WHEREAS, the effective date of the zoning of said certain land by said Ordinance No. 1071 and the effective date of said Ordinance No. 1071, itself, was the 3rd day of October, 1960, and WHEREAS, as required by Ordinance No. 1071, as amended, the City Council, after referral, study by and a public hearing before the Planning Commission of the City of Kent, wherein it was recommended that said land be rezoned from M -A (Industrial - Agricultural) zone to M-1 (Light Industrial) zone; and WHEREAS, it is found that the said rezone is in the best interests of the health, welfare and morals of the citizens of the.City of Kent and is consistent with the comprehensive plan of the City of Kent and consistent with good planning; and WHEREAS, thereafter the City Council of the City of Kent did, upon the 7th day of June, 1971, hold a public hearing on said recommendation insofar as it related to said certain lands, said public hearing being held after proper notice thereof; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON, DO DRDAIN AS FOLLOWS: Section 1. The following described land, situated in the City of Kent, County of King, State of Washington, and Dresently zoned as M -A (Industrial -Agricultural) zone and more -1- particularly described as follows: That portion of the southwest quarter of the southwest quarter of Section 1, Township 22N., Range 4 E., W.M., and that portion of the northwest quarter of the northwest quarter of Section 12, Township 22 N., Range 4 E., W.M., in I:ing County, Washington, described as follows: Beginning at the southeast corner of the northwest quarter of the northwest quar- ter of Section 12, Township 22 N., Range 4 E., W.M.; thence north 01153'35" east 30 feet to the north line of South 212th Street (O'Brien Road) and the true point of beginning; thence north 0053'35" east along the east line of said northwest quarter.of the northwest quar- ter 1270.66 feet to the northeast corner there- of (said corner also being the southeast corner of the southwest quarter of the southwest quarter of Section 1, Township 22N., Range 4 E., W.M.); thence north 1013'19" east 446.96 feet along the east line of the southwest quarter of the southwest quarter of Section 1, Township 22 N., Range 4 E., W.M., to the southeast corner of a tract of land conveyed to Dennis Tanaka, Ed Tanaka and Betty Tanaka under auditor's file No. 4511893 in King County; thence westerly along the southerly line thereof 295 feet to an angle point; thence northwesterly along said south line 210 feet to an angle point; thence northwesterly along said south line 165 feet to an angle point; thence northwesterly along said south line 29 feet more or less to the northeasterly corner of a tract of land con- veyed to Annette Murtha under auditor's file No. 4679200; thence south 509.89 feet more or less to the southeast corner of said Murtha Tract; thence west along the south line of said Murtha Tract to the east line of Secondary State Highway 2-M (West Valley Highway); thence south 1001'05" west along said east line 67.76 feet to the south line of said southwest quarter of the southwest quarter; thence continuing south 0048'23" west along the east margin of said highway 586.87 feet to the north line of the south 726.96 feet of the northwest quarter of the northwest quarter of Section 12; thence south 88°58'32" east 625.00 feet; thence south 0°48'23" west parallel to the west line of said northwest quarter of the northwest quarter 696.96 feet to the north line of South 212th Street (O'Brien Road); thence along said north line south 88°18'46" east 423.42 feet to an angle point; thence south 88°02'97" east 246.42 feet along said north line to the true point of beginning. is hereby rezoned to M-1 (Light Industrial)zone. -2- Section 2. The Planning Director of the City of Kent be and he is hereby authorized and directed to indicate upon the Comprehensive Planning Map of the City of Kent, or upon an addendum thereto, the zoning of said property as provided for in Section 1 of this Ordinance. Section 3. That upon said amendment being. shown upon the Comprehensive Planning Map of the City of Kent, or upon an addendum thereto, the copy of said map or addendum shall be filed with the County Auditor of King County, Washington; and the City Clerk of the City of Kent be and she is hereby authorized and directed to record this Ordinance with the County Auditor of King County and pay the filing fee therefore. Section 4. This Ordinance shall not be published until the applicant has entered into a written agreement with the City covering access, ingress and egress, set -backs, landscaping and off-street parking in accordance with the recommendations with the Kent Planning Commission at its special meeting of May 25, 1971. Section 5.
